MICKEY A DONALD In "CLOCK CLEANERS" THE REGISTER-GUARD, Libel And Radio Discussed In Current Review In the interest of freedom of discussion, held to be vital to pres ervation of this country's form of government, radio broadcasting companies should not be compelled to stand as insurers against libel and slander, it is declared by Frank E. Nash, second year law student. in an article in the current issue of the "Oregon Law Review" puD lication of the University of Ore gon law school and official organ of the Oregon State Bar. Nash's article, which won lirst prize In the 1938 Hilton prize con test, thoroughly analyzes we ap plication of law of libel and slan der to radio broadcasting. Pointing out that at present radio broad- casting companies are regarded more as publisher, Nash believes that their position should be that of the newspaper vendor, or a telegraph company, in which case the broadcasting company would not be liable if he could prove that he did not know the material broadcast contained libel, and that he did not have any ground for supposing that the material was likely to be libelous. In another article on "Defama tion By Radio," Andrew J. New- house, who won second place in the Hilton contest, says, "to meet the demands of social justice, an imposition of strict liability on the part of the broadcasting company seems necessary. Radio defama tion should be regarded as a new wrong in the field of torts, which should be given a place of stabil ity and certainty in our law by adequate legislation."
