Court Frees 11 Convicted Reds SAN FRANCISCO, Jan. 20 -Eleven person convicted of Com munist activities in violation of the Smith Act were freed today by a U. S. Court of Appeals. The deci sion said the act had been reduced to a "virtual shambles" by the Supreme Court. The 11 include Joe' Hall, right hand man in Hawaii of Harry Bridges, the West Coast long shore boss. Judge Richard H. Chambers wrote that the Supreme Court de cision of last June "leaves the Smith Act, as to any further oros ecution under it, a virtual sham bles." Two other judges con curred in reversing the convic tions. Net gnfOcleat Greene Last June, the Supreme Court ruled that mere membership in the Communist party was not suf ficient ground for Smith Act con victions. The decision said "preaching abstractly" was not a crime under the act. The decision was based on the conviction of 14 persons, including Oleta O'Connor Yates, in Califor nia, and freed five of the 14. The plane brought anti-cobra serum from Vienna in response to an SOS from an Innsbruck hos pital. I A mother and four of her chil dren were found dead of asphyxia tion tonight in a home at Old Con cord, about 12 miles south of Washington. The father and three other chil dren were overcome. They were rushed to a hospital her and were reported in fair condition. Dr. Rene Jacob, a resident doc tor at the hospital, said the vic times were overcome by carbon monoxide poisoning. He identified the dead as Mrs. Dorothy Cox. 29; Eugene Jr., 11: Randy. 7 months; Teresa, 9; and Dale. 10. At the hospital were Eugene Cox Sr.. 38; Terry, 4: Marilyn, S; and Ricky. 2. A oily 35' Changes Asked In Federal Law On School Funds WASHINGTON. Jan. 20 UfiTht Eisenhower administration asked Congress Monday for changes in the laws which provide federal aid to school districts where enroll ments art swelled by federal ac tivity. The changes would mean a cut of an estimated (04 million dol lars in the appropriations estimat ed to be needed for the 1969 fis cal year beginning July 1. With out the cuts, it was estimated the funds would total 211 million dol lars. Elliott L. Richardson, assistant secretary of health, education and welfare, went before a House Ed ucation subcommittee to explain administration proposals. In his budget message, Presi dent Eisenhower said the federal aid program should be modified. He said many of the communities far which grants have bees made o longer have problems as acute a those suddenly generated by axnanaioa of the defense wort durinf the Korean crisis. The program should be contin ued, the President said, dui re stricted to instances where the federal personnel both live and work oa federal property. Grants on behalf of people living on tax able property should be gradual ly reduced and then enoea, said.
