Icardl and former Army 8gt. Carl Lo Dolce of Rochester, N.Y., also a member of the llolohan mission, were tried and convicted in absentia by an Italian court and received life sentences. Since they cannot be extradited, the sentences are meaninglss. And legal authorities have ruled that they cannot be tried for murder in U.S. courts. Lo Dolce did not testify before the House subcommittee. No charge has been brought against him in this country. Flewa U Testify The prosecution, headed by Vic tor C. Woerheide of the Justice Department's Internal security di vision, will rely heavily on Italian witnesses. Eighteen Italians have been flown here to testify as gov- , t. . . 1 1 ernmeni witnesses, many iH.inem i appeared before the grand , Jury which indicted Icardl. Icardl. both before and after the perujry Indictment was re turned, has steadfastly insisted he was "absolutely Innocent" of any! complicity in Holohan's death. Icardi's attorney, Edward Ben nett Williams, recently spent two weeks in Italy, accompanied by former FBI Agent Robert Mahen, who specialized In international Investigations. ' "We're going to have witness es," Williams commented, refus ing to say whether any of them would be from Italy. Body Recevered , The investigation Into Holohan's diiappearance, begun after the war, was stepped up after recov ery of his body from icy Lake Orto, west of Trieste, in 1950. The body was encased in a aleepuig bag and weighted with Stones. An autopsy revealed Holo han had been poisoned and shot through the head. Few details of the story were revealed at the time. Italian po lice said two Americans and two Italian partisans were involved in the slaying. For more than a year there was no comment from the Defense De partment. Then, on Aug. IS, 1951, as Italian authorities moved to bring Icardl, Lo Dolce and the two Italians to trial, the depart ment got out a long statement on the case. It accused Icardi and Lo Dolce of the killing. . Finally Confessed The House subcommittee re ported that in June, 1930 the two Italian partisans, Guiseppl Mannl and Gualtlero Tozzini, "were trapped into a series of contra dictions and finally confessed. Im plicating Icardi and Lo Dolce in the murder of MaJ. Holohan." The two Italians also were put on trial in Italy, but they were ac quitted. The subcommittee also said , that following a lie detector test Lo Dolce in August, 1950 "finally j admitted participation with Icar di, Manni and Tozzini in the mur-1 der of Holohan." I The story related by the De- fense Department, the subcom-1 mittee and the Italian court trial began when Holohan, Icardi, Lo Dolce and an Italian partisan, Tullio Lussi, were dropped by darachute Sept. 28, 1944 on Mt. Mattarone, 100 miles behind the battle linea. Allied armies then were advanc ing in Italy and partisan groups controlled considerable territory. These groups represented many different political colors, the lar gest of which was the Commu nist group.
