KJ (Story also on Page 1) The alert eyes of a 12-year-old Salem boy are responsible for dis covering a vital piece of evidence in the most baffling murder case to confront state and Marion Coun ty authorities in years. ' When Ervin Kaser was shot to death near Silverton on the night of Feb. 17 by a3 unknown assail ant, a big obstacle in the path of officers from the start was the lack of a murder weapon. And last Sunday, three months after, the shooting, Larry Wacker, 853 .Gaines. St., found a rifle in the Pudding River east of Salem. Thursday District Attorney Ken neth Brown identified it as the murder weapon. Because of this and other evi dence Brown will ask a Marion County Grand jury Monday to in dict Casper A (Cap) Oveross in the case. A previous grand jury refused to indict Oveross on a mur der charge shotrly after the shoot ing. ' Oveross, a part-time -Silverton carpenter and farmer," was born near Rocky Four Corners on. Abi qua Creek north of Silverton and has lived in the Silverton area all his life. He is now visiting rela tives in Northern California. Lived ia Evergreen . He and his, wife, Ethel, lived for 30 years in the Evergreen commu nity about a quarter mile from the scene of the killing, before they were divorced last falL Police indicated that Oveross blamed Kaser, himself separated from his wife, for the split up of nis family. Mrs. Oveross is a twin sister of Mrs. Harvey Kaser, whose husband is a brother of the slain man. Oveross is generally well-liked by his townsmen and- neighbors and exhibited few traits that drew attention to him. sHU arrest touched off quite a legal battle between his attorney Bruce Williams of Salem and Dis trict Attorney Brown. Oveross ap peared in Marion County District Court on Feb.; 23 and was granted a preliminary hearing for the fol lowing Wednesday. Protest Filed But before that could come off the grand jury was called. Wil liams protested strongly on the early grand jury hearing and said k aeprivea nis client or a pre liminary hearing. Brown said he was only trying to speed up justice District- Judge E. O. Stadter Jr., ruled in favor of Brown. Since Oveross release, the in vestigation has continued. Several persons, considered close to cir cumstances surrounding the mur der, have submitted to lie-detector tests. It is anybody's guess as to what the grand jury will do Monday when it meets to consider the evi dence. I "I got in behind him and hit him in the tail," he - said. "He began trailing white smoke and pieces of the plane, were falling off. I saw the pilot come tumbling out of the aircraft."
