Wednesday, April 21, 1954 Section 4 m Appeal Due on Coast County Seat Election The State Supreme Court Wed nesday will hear arguments in the suit brought by John D. Kosydar attacking the election which resulted in transferring the Lincoln County seat from Toledo to Newport. Plaintiff contends the election was not called by the County Court as required by law. Mem bers of the County Court are listed as defendants in the suit. The suit previously was dis missed by the Lincoln County Circuit Court and plaintiff ap pealed to the Supreme Court. Kosydar filed the suit in the role of a taxpayer. Also to be heard Wednesday Is the case of the State ex rel State Dental Association, against members of the State Board of Higher Education, involving the management of the State Dental School in Portland. The Dental Association con tends the school is a separate and distinct department of the higher educational system, to be administered directly under su pervision of the Higher Educa tion Board. Defendants contend the dental school should be an appendage of the University of Oregon. Marion County Circuit Judge Bex Kimmel held for the dental association. Volume declined, to 1,860,000 shares from 2,430,000 Monday when the market suffered a sharp shake out including a late tape. Tuesday the list narrowed to 1.167 individual issues from 1,245 Monday. There were 453 decliners and 404 risers while 310 closed unchanged. There were 64 new highs and 15 new lows established. The Associated Press average of 60 stocks declined 10 cents at $119.00. It lost 90 cents Monday. The industrial component climbed 30 cents but railroads dropped 50 cents and utilities held steady. RAIL BELL FOR CHURCH JAMAICA, N. Y. Instead of announcing the approach of a Long Island train, an old engine bell will call the Basimbiti tribe in Tanganyika, Africa, to relig ious services. Maryknoll mission er Denis E. O'Brien, a former Marine sergeant, wrote friends that his new church lacked a bell.
