The court said that the suryey had been ordered be cause of a dispute among the Wagner brothers, property owners in the area, who have been in formed that the county intends to remove all obstructions from the road. JUVENILE ACTION TOLD One youth charged with thefts in Salem last month has been re turned to MacLaren School for Boys and another placed on a farm for rehabilitation under custody of Marion County Juvenile Court, it was reported Wednesday. One who had stolen a car was on parole from MacLaren and the parole was revoked. The other was charged with entering a home to take bottles of liquor. Com mercial St. Court Affirms Verdict on Water Rights The State Supreme Court Wednesday affirmed a decree of Circuit Judge M. A. Biggs, Harney County, in a suit brought by Earl W. Withers and others, involving a water right. The lower court held that the state forfeited its water right dur ing 13 years it owned a 40-acre tract of land in Harney County for failure to irrigate although water was available from Mill Creek and Coffee Pot Creek. The opinion was written by Jus tice Hall Lusk with Justices Earl C. Latourette. Walter L. Tooze and George Rossman dissenting. The state acquired the land by deed but sold it in 1945 to Ralph E. Reed. The state eneineer had applied the forfeiture law to the state and contended its successor. Reed, had no right or interest in the waters of Mill Creek or Cof fee Pot Creek. "Here the public interest is manifest," Justice Lusk wrote, "and any other construction would tend to diminish the value of the act and to defeat what we con ceive to be the intention of the legislature." A Salem area high school stu dent will be selected Tuesday, April 22, by Salem Odd Fellows Lodge for an expense-paid trip to the United Nations headquarters this summer in the lodge's UN Pilgrimage for Youth project. Schools of the area are to enter candidates qualified by scholar ship, leadership, interest in world affairs and a school essay contest on either "My Community and the World" or "What the United Na tions Means to Me." The candidates from the schools will submit their winning essays and a three-minute talk on " the same subject before the Tuesday night lodge meeting where a panel of judges will select the grand winner. Thirteen other Oregon youths will be similiarly selected for the pilgrimage. Chairman of the Salem lodge contest is Delbert Downey. Youth Jailed For Ramming Road Guardrail A Salem youth who admitted deliberately damaging the new South River Road guardrail with his car 10 days ago was arrested Wednesday, pleaded guilty, and is to be sentenced Friday. Donald Lee Smith; 18, of 392 S. High St., pleaded guilty in Marion County District Court to a charge of injuring a guard rail ing erected upon a highway. He was committed to the county Jail pending; sentence.. Deputy Sheriff Harvey Fran kum, who made the investigation and arrest, said Smith told him he had battered the metal rail ing, between the road and rail road, with his car because he planned to junk the old model auto and thought that would help. He said he had since wrecked and sold the car. Two hubcaps found at the scene of the damage, occurring only a few weeks after the rail was in stalled, aided in finding the driver. The court said the tharge called for a maximum of three months in jail or $100 fine. It also asked the County Court to assess the damage caused. YM Activities Described at Rotary Club Some of the youth activities of Salem YMCA, described as serv ing some 3,000 persons in the community, were told by partici pants to Salem Rotary Club Wed nesday. The club, holding its luncheon in the YM dining room, had a program directed by Dr. Frank Bennett. YM board chairman, and took a tour of the facilities. The speaking was done by Jer ry Duncan, president of Bush Cougars Gra-Y Club; Clay Newell of Englewood Gra-Y, on Camp Silver Creek; Shirlee Wilcox of Parrish Junior High School on girls' activities; Douglas Raines, speaker of the house for the Hi-Y Club Youth and Government leg islature; Bill Dunsworth, presi dent of the junior board of direc tors, concerning that group and the Junior Leaders Club. 5th Candalaria Tract Platted Fifth residential addition plat ted by the Grabenhorst realty firm in the Candalaria Heights area of Southwest Salem has been accepted and will be opened soon for sale, the firm announced. Special awards to freshmen will be made by Phi Beta Kappa after the middle of May on the cam puses of Willamette University, Linfield and Oregon College of Education, according to local members. The awards, consisting of a copy of Bartlett's Quotations and a copy of the Phi Beta Kappa Handbook, are awarded to the most deserv ing freshman on these campuses. The ' freshman must excell in scholarship, leadership and future promise. Committees were appointed at the Monday evening meeting to choose the recipient of this award on the campuses. Appointed for Willamette is Dr. Martha E. Springer, associate professor of Biology. Also at the Monday meeting was Dr. Edward A. Taylor, head of the Linfield College Sociology Department, who addressed the group on the subject, "Families in Crisis."
