To Accept Loss
The state supreme court held
Wednesday that the Richardson
Motor Company of Portland must
accept a $2,262 loss because it
cashed a forged bank draft from
an automobile buyer.
The decision reversed the Mult
nomah county circuit court.
The company sued Bouthilller
Motor Company, also of Portland,
to obtain reimbursement for the
money it lost as a result of the
forgery.
Records in the case show that
in 1947, a man with a $2,262 forged
draft on a New York bank, bought
a car from the Richardson Motor
Company, and received the car
and $252 in change. The next day
the man sold the car to Bouthlllier
Motor Company for $2200.
When the fraud was discovered
Richardson sued Bouthilller, and
the former won in the circuit court
of Judge Martin W. Hawkins.
Justice - Harold J. Warner held
Richardson to blame for cashing
the draft without identification.
