The new $5,000,880 USS destroyer Kearny, on patrol duty In the North
Atlantic, was struck by a torpedo October 17 about 350 miles soutn
west of Iceland bat escaped any serious damare and is proceedinr
under its own power. It was presumed the Kearny opened lire un
der President Roosevelt's "shoot first" order but the Navy Depart
ment had no farther details on the incident first in which an Ameri
can warship has been struck since World War II began. No casual-

Mr. and Mrs. Thomas arrived
here recently from Colorado and
were reported to have conferred

refused to comment on the case.
Smith was killed by Thomas,
while en route from Idaho to
Aberdeen, Wash., where the for
mer's mother was reported seri
ously -ill. Thomas was hitch-hiking
and was invited to ride in
Smith's automobile.
