Walker based his decision on the fact that Wins- low had been granted no hear ing before his discharge. The civil Service commission will ask the council to appeal the case to clarify the civil serv ice amendment to the city char ter, which provides for no hear ing before discharge, a point which Walker's opinion intimat ed might be unconstitutional. The commission's action was taken after Chairman David O'Hara and Alderman James H. Nicholson of the council police committee refused to sit with the body. Present were Brazier Small, A. A. Gueffroy and A. H. Moore, commission members; City Attor ney Paul R. Hendricks; E. M. Page, attorney for Minto; and City Recorder A. Warren Jones. Chief of Police Minto was in structed not to permit Winslow to return to duty until action as been taken by the council. Chairman Small reported that a compromise had been offered by W. C. Winslow, attorney for Frank Winslow, whereby Wins low would not press a claim for about 11300 in back salary If no appeal were iftsea..
