The right of a hotel or other
public place maintained for profit
to pick up by radio copyrighted
musical selections for the enter
tainment of Its guests" unless it
censed to do so Is Involved in a
case oendlng in federaLeourt here.
The action was brought by Mau
rice J. O'Sullivan. Kansas City at
torney, in behalf of Gene Buck,
president of the American Society
of Composers. Authors and Pub
lishers, against DeSylva. Brown
Henderson. Inc., music publishers,
against Wilson Duncan, operator
of station KWKC of Kansas City.
and the Jewell-LaSalle Realty com
pany operator of the "LaSalle hotel
in Kansas City.
The petition alleges neither de
fendant was licensed to perform in
public and for profit the music
copyrighted by the plaintiffs. I
contends that- eight numbers
broadcast by KWKC and picked
up by the hotel on its central re
ceiving set and distributed to its
various rooms constituted an in
fringement of the copyrights.
. The plaintiffs seek injunctions
against the radio station and hotel
and damages of $260 plus attor
ney fees, for each of the eight mu
deal numbers,,,
O'Sullivan says the law suit in
volves only commercial users of
radio and does not affect the pri
vate set owner.

Hold Gathering

(AP) The boards of regents of
the University of Oregon and of
Oregon State college met here
Monday in Joint session with Gov
ernor Patterson In a closed meet
ing presided over by the govern
or. I
The purpose of the meeting was
not discussed by anyone connec
ted with it, and those concerned
refused to reveal later what had
transpired behind the doors. Im
mediately after the meeting each
board of regents met separately.
Both President Kerr of Oregon
State college, and President Hall
of the unirersity refused to make
any statement regarding the mat
ters discussed at the meeting,
referring questioners to Governor
Patterson, who likewise declined
to enlighten bis Questioners.

State Battalion
Moved To Idaho
BOISE. Idaho, Oct. 30- (AP)
Approval for transfer of the
Oregon batallion of the 116th reg
iment of engineers to Idaho was
received here by Colonel M. G.
McConnell, adjutant-general of
the Idaho National guard. This
unit wilLplace the entire regiment
of engineers in this state as one
battalion.
The annual trade show and con
vention the Radio Manufactur
ers' association Is to be held in
Chicago again next year. The date
is the week of June 3.
