The action was brought by Mau rice J. O'Sullivan. Kansas City at torney, in behalf of Gene Buck, president of the American Society of Composers. Authors and Pub lishers, against DeSylva. Brown Henderson. Inc., music publishers, against Wilson Duncan, operator of station KWKC of Kansas City. and the Jewell-LaSalle Realty com pany operator of the "LaSalle hotel in Kansas City. The petition alleges neither de fendant was licensed to perform in public and for profit the music copyrighted by the plaintiffs. I contends that- eight numbers broadcast by KWKC and picked up by the hotel on its central re ceiving set and distributed to its various rooms constituted an in fringement of the copyrights. . The plaintiffs seek injunctions against the radio station and hotel and damages of $260 plus attor ney fees, for each of the eight mu deal numbers,,, O'Sullivan says the law suit in volves only commercial users of radio and does not affect the pri vate set owner.
