Angeles men testified today at the
superior court trial of Henry Hlbba
and Thomas, Hennessy, -who are
charged with perpetrating a gi
gantio' rail, merger swindle, that
they put a total of several thous
ands of dollars into the venture
with the expectation of receiving
pro tits at the rate of 10 to 1 or
15 to 1 but that so far all they
had received for their money were
"Dickey Birds."
"Dickey , Birds." It developed
from the testimony, were type
written documents given by Hlbbs
and Hennessy ln acknowedgement
of the receipt of money from in
vestors. These provided that In
vestors should- be remunerated at
the rate of $10 for every dollar
but the proviso was added that in
case the proposed merger of one-
third of the railway mileage of the
Lnited States was not consu
mated the member of the firm
whose name was attached to the
"Dickey Bird", should be free of
all financial responsibility to the
investor. , ,. , t
'. The witnesses said they were
told the merger. plan had the ap
proval of. the interstate commerce
commission., that the government
was so eager to have the plan go
through that the treasury was act
ing as a kind of. trustee for funds
and that in the event of its suc
cess Hennessy and Hlbbs were to
receive their commission from the
United States treasury department.
