7 SATURDAY, JUIID 4, 1C WILL NEWBERRY HIS OWN BEHALF? Washington. June 4. (WASH INGTON BUREAU OF THE JOUR NAI.) Intereat in the election con test directed against Senator Truman H. Newberry, based upon admission that $176,000 was used to procure his nomination in the Michigan Re publican primaries, and the allega tion that two or three times that sum was actually expended, now largely centers upon whether Mr. Newberry himself will be brought to the witness stand to face the charges. . Attorneys representing Henry Ford confess that they are anxious to have an opportunity to ask questions of Mr. Newberry direct. ? They -, could not ; do that when -the senator was on trial In Michigan because a defendant cannot be forced to testify in court, and Mr. Newberry preferred not to testify. TESTIMONY BAB&ED Neither could the other IS defendants be placed on the stand to tell what they knew, and in the nature of th&-ease the testimony of these ' defendants would throw a great deal of light where the money came from, how It was spent and how much there was of It' Senator Charles E. Townsend, the Michigan colleague of Mr. Newberry, addressing the senate committee on privileges and elections in his behalf. said he "knew tha animus back of this desire tS have Mr. Newberry 'testify. He said he would offer no objections to a further investlration "If it is broDOsed to allow interested persons, for finan cial reasons probably, to continue this investigation for purposes of notoriety.' PEfcSECTJTIOX CHABGED He asserted his belief that Newberry l being "persecuted," and if the inves tigation , goes on he Wants it confined to "proper limits, in place of giving unlimited opportunity for "muckraking -at- the expense Of the government" The position of the attorneys for Ford is that the senate should hear all wit-, nesses who can' present evidence bear? Ing -upon the fitness of Newberry to occupy a seat in the senate. In addition to the testimony presented at the. trial In Grand Rapids, when Newberry and his co-defendants were convicted. It is desired to proceed .with all charges against, Newberry, except that the su preme court has eliminated the charge that violation of the federal corrupt practices act in relation to the primary amounted to a crime against the United .States. . A , . : ... ISSUES ARE RETIEWED ; The questions remaining are whether Newberry violated the law of his own state covering the same' matters, rhe validity of which: remains unchallenged ; whether or not sums two or three times larger than Newberry's managers have admitted were spent to procure his elec tion ; whether Newberry - himself did actually Contribute a large part of the money ; to what extent -the corruption of voters was practiced, and whether New berry is -fitted, by reason of his record; to sit in the United States senate. It was pointed out that Newberry's counsel, before the supreme court de cision,: stated for the' record that it the case was reversed ' on constitutional grounds, the investigation should pro ceed under the authority of the senate to determine the fitness of its member ship. The reversal of the case was upon that ground. s ATTORNEYS CONFIDENT Attorneys for Ford express confidence that If they have the privilege of cross examining NeWberry and -certain others they will be able to show exactly where the big Newberry: fund came from and they ask permission to trace this" money back to its sources from the men who know. It was evident that some of the New berry sympathisers had trusted to the Republican majority in, the committee to squelch the Investigation without ceremony. This plan fell down when Newberry's attorneys were quoted as saying that the Investigation should ge on if the supreme court returned the kind of decision It actually did,, return. So the sub-committee is going ahead, but with prospect that there will , be a ho the r battle over evidence before New berry ihimself and the other defendants are -called to the stand.
