NEWBERRY CASE

- Jury Has Stupendous. Task in
Weighing Testimony of 500
Witnesses and 150 Exhibits.

lta heaviest guns at United States
Senator Truman H. Newberry and
hla 122 co-defendants on trial here
for election frauds in the senatorial
campaign of 1918.
At the close of the fourth week of
testimony taking; today. Special Assist
ant Attorney General Dglley announced
he would make eerytffort to close the
prosecution's case within a week. The
oncluding days of the government's at
tack on the Michigan organisation which,
, It Is charged, conducted one of the most
corrupt political campaigns in the coun
try's history. I expected to be devoted
to short range sniping at Individual al
' leged offenders.
Counsel for the defense announced to-
night that the defense will not require
more than two weeks to present its case
and that It should be In the hands of
the Jury by March 15.
This jury has a stupendous task on
its hands.
It must decide whether there was
conspiracy planned between Senator
Newberry and hie principal advlaers to
deliberately buy a seat In the senate.
It must decide whether the 122 de
fendants, who are on trial, participated i
In this alleged conspiracy.
It must examine 1(0 government ex
hibits. Including nearly 1000 telegrams,
to determine whether all these men act
ed In conjunction.
It must examine the testimony of ap
proximately BOO witnesses to determine
whether any defendants, if not all, are
' guilty of fraud or conspiracy.
It must decide what, if any, penalty ;
is to be meted out if the men are found
"guilty.

The philosophy of the McAdoo group
seems to be that the Democratic con
vention wilt choose a candidate who has
the largest potential strength in the mat-
ter of vote getting. Thus is McAdoo
trotted out as the friend of the suf- j
fragleta. the farmer, the soldier, the I
union labor organisations, the business
men and bankers of the country and
the advocates of Americanism.
ADMINISTRATION INDORSED
" On one thing, however, the McAdoo
candidacy will not be ambiguous. Others
may say. as Bryan has adroitly done, I
that the "general principle" of the Wil- J
son administration Is approved. Mc
Adoo will say without the slightest
twinkle In his eye that he wholeheart
edly approves of the Wilson administra
tion. That, however, may be his admission
ticket to the San Francisco convention,
for the delegates. In all probability, will
not be the Bryan men of old, but the
dyed-in-the-wool Wilson men, office
holders or friends thereof, whose politi
cal offices have been made possible by
the Incumbent of the White House under
Democratic rule. McAdoo, to conclude,
1m a candidate. .He will not seek the
job himself. Others will try strenu
ously to do it for him.

Lieutenant Frank Ervin of the 'traffic
bureau is carrying the campaign of k
cldent prevention Into Portland schools.
Last week he went to the Montavllla,
Rose City park and Failing schools with
slides, showing the causes of accidents,
lecturing thereon, and organizing safety
organisations within the school.
"Never walk Into the street from be
hind any object," he told the children
at the Falling school Friday. "Never
walk from behind an automobile that
may be parked near the curb, a wood
pile, or anything that obstructs the view,
until you look in both directions for an
automobile that may take your life any
Instant.
. "Never use a coaster wagon or push
mobile on the streets. The streets were
never constructed for you to play on.
And don't carry an umbrella down over
the face and eyes.
"Stealing rides on the back of auto
mobiles and wagons Is very dangerous.
You may steal rides a great many times
and you may once to often, and be
struck by a nautomobll or motorcycle
and killed or left crippled for the rest
of your life."
Lieutenant Ervin organizes safety
guards at each school, guards who are
released from classes one minute early
to keep the children from running Into
the street when classes are dinmlssed.
He will go to every school in the city
lecturing on accident prevention methods.

But the main fact is that no man
, ever suffered In politics from an at
tack based on personal grounds that
were Inertly unobjectionable.
Their candidate will " be. accepted or
rejected at San Francisco on other

It is interesting in talking to some of
" these McAdoo supporters and some of
them have high official positions In the
government to find how easily they
seem to eliminate all the other candi
dates for .the Democratic nomination.

Hoover, they insist, has eliminated
himself by expressing innocence of any
party affiliation, and to get- a : Demo
cratic nomination, an Individual must.
In their opinion, have been a Democrat
at least us far back as 1112, though he
might be forgiven lapses In the period
' before that.
As for Governor Cox, the KoAdoo peo-
' pie think he is unfortunately on the
wrong side of the prohibition question
and will not be a strong contender.
Senator Pomerene of Ohio has al-
' ready withdrawn from the race, and
Bryan, say the McAdoo disciples, doel
not really want the nomination for him
self, but wants to have the pleasure of
dominating the convention.
The big question is whether or not
Bryan will be a delegate.
Nebraska In all probability will settle
that In the negative very soon.
. PALMER STRONGEST OFPONENT
Admittedly. Mitchell Palmer Is the
. most powerful opponent of William
Glbbs McAdaa. Both are strong Wil
son followers, but among the McAdoo
men one hears serlvus doubts expressed
as to the attorney general's ability, and
- of hie unhappy contact with union la-
. bo i- in the coal strike.
In contrast they point out the record
. of the formei director general of rail
roads, who gave the railroad brother-

. more sympathetic treatment In the mat-

Abel this afternoon,, who said that two
additional alienists have een sum
moned to examine -Roberta They are

ing from Aberdeen, the other from
Olympla. Their names have not been
divulged by the state.
Afterward. Vanderveef la expected to
attempt to prove an alibi for the de
fendant Mike Sheehan. Sheehan, who
Is nearly 60 years old. is accused by the
prosecution of having been present in
the I. W. W. hall at Centralia when
shots were fired, but that he did not use
a gun because his efforts to handle one,
when tested by Wesley Everest, the al
leged gunman who waS lynched the
night of the shootings, proved too
clumsy.

Attorneys for the prosecution are In
terested In the nature of the proof that

the alleaed attack made by ex-service

or so of rebuttal evidence Is expected.
Despite the holiday, Judge Wilson will
not be able to go to his home tn Olympla
over the week-end. He ia anxious over
the condition of the jurors and feels
that his constant attendance on the Jury

The committee in charge of arrange
ments for the automobile and truck
shows this coming week at the Ice Pal
ace and Armory, has asked Portland
merchants to assist tem in keeping the
show before the public, through a novel
window dlaplay plan. Under thla plan,
as urged by the committee, merchants
would put an automobile tire in one
of their windows, with the regular dis
play card announcing the show. The
cards may be obtained from M. O. Wll
klns. manager of the show. Broadway

says Senator Oeorge E. Chamberlain In
answer to a query from the Chamber of
Commerce as to whether the adminis
tration intended to carry out the order
Issued last week sending all empty cars
on the Southern Pacific lines north of
Ashland to the state of Washington to
load.
"A serious shortage of cars has
obtatned for some time In the Puget
Sound territory." continues the message,
"and cars ordered from the S. P., are In
tended merely -to equalize between all
communities."
Despite' this unfavorable report, local
railroad officials still express confidence
that the administration will not carry
the order out in letter as a shortage of
cars already effects this territory.
