HEN ie mis WHY PRESIDENT Takes Up Lodge Reservations One by One and Shows What Would Have Been Effect. MADE LEAGUE UNWORKABLE They Could Easily Have Been Ironed Out Had Lodge Been Willing to Listen to Reason. By David Lawrence (Copyright, llt) , Washington, Nov. ?0. President Wilson has called the Lodge resolu tion a nullification of the peace treaty. The president in his letter to Senator Hitchcock did not go into details as to why he regarded the Lodge resolution as a nullification, but I am able to present today an analysis made by thoise conversant with his viewpoint. It will bo noted' by the analysis that aome of the reservations in the Lodge resolution did not meet the objection and would have been accepted if other changes had been made. Only a stubborn pride of opinion prevented ratification and, the points on which the two sides diffcri involve on the one band a limitation of the rights of the executive and on the other hand a prospect of mak ing the League of Nations so clumsy and unworkable that the provisions of the peace treaty itself pould not be executed. Reservation One was the preamble, hlch required three of the allied powers to accept by an exchange of notes all the reservations in order that the latter may be made part of the treaty. There was no objection to making the reserva tions binding upon other powers. AfJCEPTAKCE INDICATED No exception had been taken by a,ny ef the powf m to the reservations sub mitted to them. This would permit ac quiescence and would make the reser vations legally binding on the powers, for under international law formal no tice that a certain action will be taken i:i a specified flmt means acquiescence on the part of all concerned if they re main silent. Reservation Two is plainly unconsti tutional. It provided that notice of withdrawal from the League of Nations coukr be ac complished merely by a "concurrent res olution of congress." But a concurrent resolution is one that is adopted by both houses of congress without submitting it to the prewident for signature. Such resolutions are not the law of the land An amendment or abrogation of a treaty In order to be legal must be accom plished by an act of congress as per mits of the president's signature. PRESIDENT HAS EIGHT Congress cannot deprive the executive of the right of vote, which they would be attempting to do if only a concurrent resolution were needed to withdraw from tlie League of Nations. Also, under the constitution, the president is charged with the conduct of diplomatic relations and a concurrent resolution cannot de prive him of these rights. The flaw can be fixed by making withdrawal from the league subject to the same rules as have hitherto governed the abrogation of treaties to which the United States has been or is a party. Reservation three, which would inter pret Article 10 so as to prevent the United States from assuming any obli gation to preserve the territorial Integ rity of political independence of any member country of the league unless congress shall so authorise, was unobjec tionable if it meant that the military or naval forces shall not be used without the consent of congress, but it goes further, and would prohibit the execu tive branch of the government "from in terfering in controversies between na tions." The adoption of the Lodge reservation on Article 10 would be considered em barrassing because it would weaken the moral power of the government to exer cise any good offices even In Central and. South America without the specific consent of congress, and It Is often the ease that congress la not in session when an emergency has arisen, and there are some emergencies which can be straight ened out easily by the executive branch of the government without all the trouble of an extra session of congress. A specific definition of the reserva tion to apply only to the use of military and naval forces as provided under the constitution, and to leave the executive branch of the government free to exert moral power to preserve peace, but pre venting it from using the army or navy until congress has said so, would easily have brought support from the Demo cratic side of the senate. OTHER STATES BE5EFITED Reservation Four, saying that no man date shall be. accepted without the con sent of congress, was 'not considered ob jectionable. Reservation Five says the United States "reserves to itself exclusively the right to decide what questions are with in domestic Jurisdiction" and declares that all such questions may not even be considered by the council of the league. This is not viewed as objection able from any legalistic viewpoint, but when accepted by other foreign govern ments it would give them the same right and then England would call the Irish question a domestic affair and Japan might call the Shantung question a do mestic affair and Italy might construe the Fiume Iksus as purely domestic be cause Italians live there. All the advantage which the friends of Ireland were to e given under Arti cle Eleven of the covenant, which per mits the council of the league "to con sider" anything that disturbs friendly relations would be swept aside by the specific exclusion of domestic affairs." DOCTEI5E SAFEGUARDED Indeed, any nation could simply invoke this 'article and exclude question after question from the domain of interna tional conference. This reservation not be so invoked by the Unite dStates, but it would most assuredly be Invoked by certain governments in Europe. The purpose which the senators have in mind namely, to exclude immigration and tariff from the consideration of the league can be accomplished by a sim ple reservation stating that questions which have hitherto been regarded uni versally as domestic under internation al law shall not be subject to the con sideration of the League of Nations. Reservation Six pertains to the Mon roe doctrine. Foreign governments would hardly object to this, as it always was an Ameri" n doctrine. SEVEN IS EMBAHRASSISO Reservation Seven withheld America's consent from the Shantung settlement. While this is a commendable object, such a reservation doesn't help China. The senate would help China by in sisting that it will withhold Its consent until Japan has fulfilled the promises she made in Parus, namely to return Kachow to China. Moreover, if the preamble is unmodified then Great Brit tain and France and Italy will hesitate to go on record permitting America to diesent because an affirmative expres sion on their part might be considered an affront to Japan with whom they have a treaty covering the Shantung settle ment. The powers would be relieved of this embarrassment if the preamble simply left it to them to acquiesce within a specified time. Reservaton Eight would give con gress a voice In selecting the person nel of America's representation .on all commissions or bodies that may' be cre ated by the League of Nations. This is not objectionable but the last para graph goes en to forbid any American cittsen from serving on an International commission without the approval of the senate. KEEP ADVICE AT HOME This would prevent Americans from sitting as arbitrators or mediators In disputes In which our government la not at all concerned but in which the disinterested Judgment pf men like Elihu Root, William Howard Taft or other in dividuals might be sought by foreign countries in an effort to maintain peace btween themselves. There is grave doubt whether congress has the right under the constitution to interfere with the freedom of action of American ci tisens In this connection. Reservation Nine would give congress a voice in the acts of the reparation commission. Many in adminstraton quarters regard this aa weakening Am erica's power but this is a moot ques tlon and time alone can answer It In tta present form this reservation can not be regarded as one on which friends jt the treaty could afford to make a stand against the adoption of the whole treaty. GAVE GERM ANT EXCUSE Reservation Ten was viewed as giving any nation the right to refuse to disarm because they can all contend they are "threatened with Invasion," which was Germany's argument for many years concerning France. This might ha'we been modified to permit a nation to increase its armament only after diplomatic rela ttons have been broken with an un friendly natlou or when engaged In war Reservation Ele'ven was a reasonable Interpretation of that article of the cov enant which relates the right of allies In the United States to carry on trade with persons in this country or abroad ex elusive of the particular localities which are being subjected to an economic boy cott. Reservation Thirteen was viewed by lawyers In the administration as a "joker" that gives American citisena a blanket right to remain unaffected legally by any of the provisions of the peace treaty. It was Intended to permit reopening of cases wherein the alien property cus todian seised property partly owned by Germans and partly by American citl sens. But It has not been carefully drawn and might give rise to years of dispute and litigation. . CONGRESS MUST AGREE Reservation 14 would prevent America from participating in the International labor conferences unless congress agreed by act or Joint resolution. This is an other reservation to which much argu ment can be directed by both sides, but St.. Near Morrison VESSEL OPERATED -FOR U, S. SHIPPING BOARD DISTRESS Steamer Roman Sends Out Call; Three Vessels on Way to Give" Assistance. Boston. Mass.. Nov. 20. (T. N. S.) With a broken steering gear and leaking badly, the United States shipping board steamer Roman, New Tork for Mar seilles, sent out distress calls that were picked up here today. Three steamers, including the United States transport America, reported that they were an swering the calls from the Roman and would soon be at her side to rescue the crew of the disabled steamer. The posi tion of the Roman was given as latitude 39 north and longitude 68.50 west. The Roman carries a general cargo of merchandise valued at 11.000,000. The coast guard cutter Osslpee put out from Portland, Maine, today to rescue a sloop in distress several miles off Port land harbor. The concern manufactures the Stradivara phono graph. The constantly Increasing de mand for their product is the reason given for the larger capitalization. The company recently purchased the building at Thirty-third and East Broad way, formerly occupied by the O. K. Jeffries company, and gives employment to about 75 operatives. The number of employes is now to be increased to 1G0. and the payroll will amount to $260,000 for the coming year. The company anticipates turning out Stradivaras to the value of $1,250,000 in 1920, and will enlarge its Oriental ex port business, as well as handle the growing domestic demand. Officers of the concern are: W. B. Wiggins, presi dent ; E. W. Barlow, vice president : S. L. Eddy, treasurer. Austria Must Look To U. S. for Help, Says Lloyd George London, Nov. 20. (I. N. S.) An inter allied conference will be held shortly,' probably In London, to consider the Rus sian situation, Promler Lloyd George an nounced in the house of commons this afternoon. The premier addressed commons on peace conditions generally. Referring to Austria, he "declared that there could be no amelioration of the serious eco nomic situation at Vienna without help from the United States. It would not be held as nullifying the treaty if adopted. Reservation Fifteen, which endeavored to put on record President Wilson's con struction of what the six votes of Great Britain mean in the assembly of the league, was not in itself objectionable, though it might offend the British colo nies. It is hardly likely that Great Britain would refuse to accept the reser vation, however. Eound-Up Films to Be Released Soon .James L. Mendelson ot the Bulls Eye Film company of New York arrived in Portland this morning with 2000 feet of film thrills taken by Leland J. Burrud at the Pendleton Round-Up this fall. BuTud took a total of 11,000 feet of film but reduced this to only the best thrills. A prUe of $400 has been offered by the company for the participants in what the public Judges Is the best thrill in the entire film. The picture will be released for showing soon. Wil liam Carlisle today had outguessed seven posses, a troop of United States cav alry and the keenest sleuths of the Union Pacific railroad, hunting him fo- train robbery following his escape from Rawlins penitentiary in a wooden box. The latest authentic clue to Carlisle's whereabouts came from Casper, Wyo., where he mas said to have entered a newspaper office and nervily inquired bow the chase was progressing.
