O'Reilly Results in Action of Committee Not Beingj Sustained. ' Ous C -Moser'a appointment as legal adviser to the Port of Portland was con tested so successfully by Port Commis sioner Drake C, O'Reilly at the Thursday afternoon meeting of the commission that the matter was referred back again to the special committee that had select ed Mr. Moeer. "It would be a discredit to the commis sion to make such, an appointment." was one of Mr. O'Reilly's vigorous asser tions. , ; . Moser was the choice of a special com mittee consisting of George H. Kelly, Phil Metschan Jr. and J. D. Kenworthy. This committee had made the appoint ment in the belief that it had power to act. Mr. O'Reilly insisted that the com mission had no such authority to dele sate its powers and that the appointment of the Port of Portland attorney must be the act of the port body as a whole. " He declared that Moser Is not a suit able man for the place, not being suffi ciently versed in maritime law, and criti cised the committee for taking action before reporting back to the commission. Phil Metschan defended the selection and J. 1. Kenworthy said that he would stand by the action of the committee. Aside from assertions that Mr. Mosers knowledge of maritime law Is only super ficial it is said that the effort Jto appoint him port attorney is merely an attempt to par a political debt. Moser is saia to have been led to expect the appointment in return for his support in the legisla ture of certain phases of the new port law.
