Belt, sitting in the cir cuit court for Multnomah county, in reforming a fire insurance policy' so as to protect the Interests of the hold- r, after the property Insured was de stroyed by.fire, is upheld by an opinion of t lie supreme court handed down to day. . On the technical grounds Hint, the jlalntlff, William M. Gregan, was not absolute and sole owner of the proper-j ly Insured, the defendant, the Norll- vtesltrii National Insurance companv of Milwaukee, denied liability when the property involved was destroyed ty lite. Gregan brought suit in equity to re form tha policy, and the evidence showed that the agent who wrote the policy was advised that Gregan was buying the property on the installment plan and that the company had provid ed the- agent with a form of rider which he was authorized to attacli to policies on i nsurance on property pur chased under contract. , Another Policy Delivered. In face of this, the agent, K. H. Cooper, delivered the plaintiff a policy which, by its terms, was void "if the interest of the insured should be other than unconditional and 5ole owner ship." The court assumes that the agent did th-fa thoughtlessly rather than deliber ately, and ays that ''the mistake was a mutual one and plaintiff is entitled to relief in equity." "Plaintiff s right to relief is not barred by his failure to read the pol icy," nays .the court. "It is true that since 1D07 the form of fire insurance policies in this state has been statu tory, but they are still subject to reformation in equity, at least in the provisions wnjch local agents aro au thorized to supply and modify. If it should have appeared that Cooper had j no authority from the defendant to modify the provision in the policy re lied on by the defendant, a different question would be presented.''
