The Daily Mews has filed a demurrer to the complaint of Nathan B. Harvey, who Is suing the paper for $116,000, al leged damage for.Jibel In conecting his name with the Hill family murder. which occurred at Ardenwald In June. 1911. Harvey lost the first suit hs brought for 876,000 damages for libel, and the pending auXt Is a result of the report mads by the News of the court's decision in th first' suit. In its de murely the News contends that the article was not libelous; that it did not charge anyone with certainty, and that it w&s privileged. FINED FOB SELLING LIQUOR Sum of $50 Assessed Against Law Violator. Frank 8peUetlch today pleaded guilty, before Judge Bell in tho dis trict court, to bootlegging at 195 8lxth street and was given a fine of $80, and the court ordered the liquor stock destroyed. The charge against Mrs. Spelletloh. who was arrested with her husband at the .time the con stable's offloe raided ths' place, was dismissed. E. M. -(Cooper, who was caught buy ing, liquor at the 8pelletich residence, is, wanted at Boise, Idaho, on a charge of wife desertion, according to ad vices received today by Constable Weinberger from tbe sheriff at that place. LIQUOR WILL REMAIN IN THE CUSTODY OF COURT FOR PRESENT Deputy District Attorney Ap peals Case After Judge Had Released Wet Goods, ' District Judse Jones clashed with the district attorney's office this' morning in connection with the Mar tin Fromme liquor case. About a month ago SO gallons of liquor was seised at the Fromme resi dence. 788 Division street, and has since been in tho custody of the sheriff. Today Fromme walked into the sheriffs office with an order signed by Judge Jones directing Sheriff Hurlburt to return tho liquor to Fromme. A few minutes later Denuty District Attorney Ryan heard about the order. The district attorney's offlee bad not been served withes, notice, that ths Fromme case, which Judge Jones bad taken under advisement, bad been dismissed. Asks Court About X. Ryan rushed Into Judge Jones' courtroom, where a case was in prog ress. . "Did the court make an order In the Fromme case?" asked Ryan or the judge. The Judge nodded. Xdanor Sad Been Seised. The Fromme llouor was seised fol lowing -a confession by UUs Ralney. who said bs and his older brother. Wil liam, -obtained liquor from Fromme for bootlegging purposes. Hs said ,hls brother was the one who always made the trips after the liquor. The older brother got out of the state, and lack ing his testimony the district attorney decided to dismiss the criminal charge against Fromme. and proceeded to bring action to condemn the liquor un der the nuisance provision of the pro-1 nlbltion law. judge Jones took the matter under advisement, but did not notify the district attorney's office when he made his decision and ordered tho sheriff to return the liquor. Now that the case Is appealed, the liquor will remain in the custody of the sheriff until a decision Is reached as to its disposition In the circuit court.
