That the law making it a crime to furnish liquor to a convict applied to men In the peni tentiary and cannot be extended to a man who has been paroled, was held today by the supreme court, which re versed, the conviction of Joe Perry In Circuit Judge Kelly's court. Marlon county. Perry furnished a man who had beea sentenced to the penitentiary but who was out on parole and doing- business for himself in, Salem, with liquor. The opinion was written by Justice Eakin. Among the other decisions today were the following: Margaret Martin vs. William Hen dershott et al, appellants, appealed f rt m Marlon county, motion to dismiss appeal denied; opinion by Justlc.i Eakin. Freeman Case Appealed. R. J. Freeman vs. Southern Pacific company, appellant, appealed from Multnomah county; motion to dismiss appeal denied; opinion by Justice Kakln. Jessie A. Miller et al vs. City of Portland, appellant, appealed from Multnomah county; suit to enforce lien for improving streets; opinion by Chief Justice Moore; Circuit Judge Morrow's Judgment for plaintiff affirmed. Henry Landers et al, appellants, vs. school district No. 5, Douglas county; suit to enjoin collection of a tax for a new school house; opinion by Jus tice Burnett; Circuit Judge Hamilton'! Judgment for defendant affirmed. John T. Davis vs. Carlton Lumber company, appellant, appealed from Yamhill county; action for damages for personal injuries; opinion by Justice Bean; Circuit Judge Holmes' Judgment for plaintiff affirmed. Motion to retax costs was denied in Gross vs. Gage. SUPREME COURT TODAY REVERSES CONVICTION OF ONE LOUIE HING Salem, Or., Sept. 21. The supreme court today reversed the conviction of Louie H'ng, Chinese, In Portland, on a charge of killing Lum Fong, another Chinese. The court holds that the in troduction of an uncertified paper, which purported to show that when ar raigned the defendant stated his true name to be Gung Shing, wag an error of Circuit Judge Davis. It was also held that the introduc tion of the testimony of W. E. Gray, a clerk In a bank, and J. Q. Rurness, a bank teller, which was of the general reputation of Seid Jan, a witness for the state, for truth and veracity, wus mi error. Three Chinese testified for the state and three ror the defense. "Each set of three Chinese either told the truth or deliberately falsified end In that state of the record the ad mission of the Incompetent writing constituted more than a mere techni cal error because It may have had much weight with the jury in deter mining which group of Chinese testi fied to the truth," Bays Justice Harris in Ills opinion. "It is likewise doubt ful whether the. language employed by the court In withdrawing the evidence of Witnesses Gray and Burness from the consideration of the Jury was suf ficiently emphatic to accomplish the purpose Intended or enough to unrtng the bell." Louie HIng was indicted for the " murder in the second degree and tho trial-resulted in finding him guilty of manslaughter. Locke Conviction Affirmed. Salem, Or., Sept. 21. The supreme court today affirmed the conviction of John A. Locke, a trainman employed by the Oregon Electric railway, on a charge of polygamy. Locke had a wife In Portland and married another iesieol. in Salem. The second wife made her home at Eugene, and Locke, who had a run from Portland to Eugene, main tained two homes. Locke was con victed in Circuit Judge Harris' court In Lane county. Justice Bean wrote today's opinion. BOUNDARY BOARD MAY CHANGE LINES OF SCHOOL DISTRICTS Salem, Or., Sept., 21. The supreme court today held that In the case of school district No. 35, Tillamook coun ty, against the district boundary board, the "proceedings, in taking from the plaintiff district part of its territory and giving it to other districts, were valid, and Circuit Judge Holmes' ac tion in sustaining a demurrer to the complaint is sustained. Justice Bur nett wrote today's opinion. The plaintiffs contention that the district boundary board, deriving Its power as it does from the legislative assembly, has no authority to change the boundaries of a school district, be cause that is tantamount to the amend ment of the charter of municipality with the Inhibition of section 2, article IV of the state constitution, is not upheld. "In substantially the present form the rule for changing the boundaries of school districts through the action of a district boundary board has been In existence from a date prior to the adoption of the amended forrrj of sec tion 2. article XI," says Justice Bur nett in his opinion. "It is one of the essential features of the constituent law of school districts." The court holds that no enactment from any legislative source has in any manner prescribed the boundaries of the plaintiff district. The constituting act. It Is held, has committed the establishment and con trol of a district to a district boun dary board, and that body In making changes simply administers and does not amend the laws under which the plaintiff district exists. Advertising Case Affirmed. Salem, Or., Kept. 21. The supreme court today affirmed the Judgment of Circuit Judge Davis of Multnomah county In the conviction of Edwin Holllnnhead on a charge of advertising the treatment of certain specific dis ease In violation of section 205, Lord's Oregon Laws, as amended by the legislature In 1913. The defendant contended that the act prohibiting the alleged objectionable advertising was unconstitutional and void. The, court holds that the subject of the act ib fairly expressed In the title. It i also held that the act is not class legisla tion, and is not in violation of the con stitutional guarantee of equal protec tion of the law. The purpose of the act is Clearly In the Interest of the public morals, the court declares. It is designed to pro tect youthful and inexperienced hu manity from designing men who would prey upon their calamities, as well as to prevent the spreading broadcast of t!ie harmful Idea that certain diseases are easily and cheaply cured, it is pointed out in Justice Benson's opin ion.
