New Angle in Fight for Basis
of Demand for Lower Car
fares Urged.
It is likely that the city council wilf
sanction tire appointment by Will II.
Daly, commissioner of public utilities,
of an expert appraiser to go over the
properties of the street car eystejn of
the Portland Railway, Light' ..v- Power
company, for us. ft by the city in rts
fight for lower far. s before the rail
road commission. An ordinance allow
ing him to make the appointment was
piven its first and second reading? by
the council at its 'meeting this m (ru
ing, and final action is extx cted within
two weeks.
Tlie entire cost for making this ap
praisement would not he more than
JiOi), according to Commission-, r Daly,
in a report submitted to the council.
jMr. Daly contends that tlie services
I contemplated would be of incalculable
i value U the city, not only as concern
ing the 'present contention of reduc
tions in rates, but also in contenipia
tion of future extensions which may be
asked of the company.
Commissioner Daiy has contended
! that in the company's tippraisemeat.
; made by its own expert-, .n any of the
! t harges in the valuations are iH.-citi-mate,
and cannot be h hi agaiti.it the
appraisement of the company's street
' car holdings.
' In his report Commissioner Daly
states: "There is much property iit-
eluded in the appraisein.nl b; t pre
pared by the company, which it con
tends is a legitimate investment, ami a
j charge against the city railway system.
, The city is deeply inter ested in strip
ping tliis appraisement of a great deal
; of this illegitimate i liai se, as tin- ap
ipraistment of the railway oempauy s
property, when adopted by the railt-i.i l
I commission, will form a basis for fil
ling rates not only of car fares, but for
other services which this company
l elldei ;s the public.
"We can hardly overestimate the
value of the service of an expert ap
praiser, acting in behalf of the city, lo
1 1
.contend for the elimination ot all in- i
,flation in values and resist and to u. -lnur
to including all investments that
are not legitimately a charge against
the street railway system and its op
eration." Commissioner Daly cNpects to have
the name of an expert appraiser ready
for submission to the other members
of the council within a few days. j

at Creston Station.
The street car tracks in tlie street at
Creston Station, on the Mount Scoti

commission men. will be torn up by the j
ity engineer. This was the edict of
the city council this morning follow-j
ing Commissioner Daly's announcement i
that the owners had ret used to com
ply with their agreement with the city
to remove the tracks within a certain
bpecified time.
More than a year ago the commis
sion men were given a short extension
of time in which to remove the ob
structions from the street, but th3
tracks still remained. The city will
now remove the tracks and the costs
will ha assessed against the owners.

being sent to the various fire stations j
today.
While no definite action has yet I

will be made to eliminate the provi- j

COUNTY WILL PAY
EOFES
Contractors for Court House
to Get Certificate of
Completion.
William M. Whlddon of tVhldden &
Lewis, architects of the courthouse,
was authorized by the county conimis-
1 '
this morning to give the Shan-
company a eemucaie ot coin-
pieuon or its contracts ana tne com-
tract for placing tlie outside stone
work and for other parts of the build
ing and was delayed SO days, for which
J."0 a day was retained us penalties.
Attorneys R. 1-jjjDennison and Robert
Shaw, representing the company, point
id o-it that the "Company was delayed
because tlie steel worif was not com
pleted by (). i:.' Helntz of the Pacific
Iron works, and that it was not until
j after the date the contract called for
completion of the contract that tho
company was able to begin work.
Three otho contracts are held up.
! the Heintz contract for 30. days or a
j total of $ 15,250; the A. J. Capron con
I tract for ornamental iron work for 1-n
days at $20 a day or $2400; and the
i Stewart Iron works contract for tlic
i jail work for lor day at $"0 a day.

the Stewart Iron works contract will
: be tutvcn up tn the m ar. future.
Sheriff Word. Commissioner I.lght-
nrr and Architec t hidden were re
quested to determine of what value the
subjail at Kelly Butte is at the pres
ent time, in order that the county com
missioners may determine what terms
ithey will offer in settlement. The ds
! lay to the new jail made necessary th-r
'erection of the silt-jail, although othef
! wise it was not needed, as It was
j necessary to wreck tiie old courthouse
I before the new jail was completed. The
commissioners feel that the company
should stand some part of the cost of
its erection.
