After months of effort , to get District Attorney s. - m Tongue of Hlllsboro. whose district be fore tha county attorney law went into effeot Included, Clatsop county, to bring a maodaauimvauit against the Sorenson liCgglng company In the interest of ths rights of Em 11 K. Mattson, the railroad commission has given up the task and today called uppn the attorney general to tilii action In the matter. ' ; The Sorenson tagging company built a logging railroad In Clatsop county, In condemnation : proceedings, brought to force a right of way. through Mattson's property, ths company was successful on the representation that the railroad was a common carrier. After the road was bulH Mattson applied for freight service, which the company denied, tak ing the ground SOW that it is purely a logging road and not a common carrier. Mattson took the matter up with the railroad commission, wntoa held a hear ing June 19 and latef decided that the question was one for judicial determina tion, and referred tba ease to Dlstrlot Attorney Tongue. On July 18 the commission forwarded all the papers in the ease to Tongue and requested him to bring mandamus pro ceedlngs against the oompaay. The commission received no reply. . Oa Aug ust IS the commission addressed an other letter to Tongue and aaksd him to acknowledge tba receipt of the first letter. Still there was no response, the letters apparently being Ignored. The commission waited until Septem ber t, when a registered letter was sent to Tongue again requesting aim to ac knowledge receipt of the first letter. This brought a reply two days later, la his lstter Tongue declared he bad an awered all tha commission's letters, at least ho said he was sure he bad dic tated and signed them and they muet have been mailed. He said , the case had been referred to hla deputy, L. X Trace y, at Astoria. .tV- . Aa nothlna- more was heard about the matter, on September tl the commis sion wrote to Mr. Tracer, who replied thai he had received the papers ; and would file the suit. - Og November Mr, Mattson wrote to the commission asking what further step eould be taken to get action. He said Traoey had done nothing. . He said Tracey told him ha didn't know how to draw us papers for a mandamus suit and that he was waiting for Tongue to nanaie tne matter.': -v , , This was too muoh for the commis sion.
