It would inter fere with its plan to double track its line, and would also interfere with Its Single track line. - - - In the opinion handed down -by the Huprome court today, which was writ ten by Justice McNary and concurred in by Chief Justice McBride and Jus tioes Bean and Kakln. the question of tne jurisdiction of tho lower court Is the chief point decided, but when the case goes back to the lower court the merits of the case, as to whether the county can rcappropriate "property a! ready devoted to a public use, will come up. The supreme court holds that the circuit court Jias Jurisdiction because the real questions at Issue cannot be decided under the road laws gvlding tne county court in laying out high ways. "No Issue can be made by plaintiff b'tore the county court on the question of the appropriation of its property," says the opinion. "The company has under the statute, neither the right to petition lor a road or to remonstrate against the establishment of one, as it is not a free-holder residing wlthlnthe road district. Nor can that all import ant question be determined, whether the county can rc-appropriato property al ready devoted to a public use." Would "Xnoite to Action." Taking up the other ground of de murror, the question of the sufficiency Of the complaint, the court says: "We think that complaint contains matters which, if true, would necessarily Incite the conscience of a court of equity Into action. We have no hesitancy In declaring tho law of this state will not permit any corporation, whatever be its legal vr political character, -to de prive a railroad, beyond its .legitimate needs, of Its right of way longitudinally when the property Is being used by such railroad In the performance of its pub lics functions as a common carrier.
