ence Darrow, the famous attorney who
will soon face a third trial in Los An
geles for the alleged bribery of Jurors

officers of the Chicago Federation ot
Labor. Darrow's friends at Chicago say
he is penniless as a result of his two

Three deaths from heat prostration
were reported Monday t at Cleveland,
Ohio, which was the hottest May 5 there

contempt of court, rather than divulge

vict and the alleged murderer of John
Reszo and two policemen. He has fled

According to advices received by the
Merchants Exchange at Seattle, Captain
Daniel Killman and his crew of 11 men
were forced to abandon the schooner
Lyman D, Foster In the South Seas.
They nut off in an open boat and landed
safely at Kamhara island, after their
schooner had become waterlogged and
helpless through bad luck and bad
weather. She was laden with 950,000
feet of lumber from the E. K. Wood
Lumber company of Belllngham.
The city council of Warrenton, Or.,
has granted a BO year franchise to fur
nish light and power wltnin the city
limits, to the Pacific Power & Light Co.
It was the first important ordinance
introduced since Miss Clara C. Munson
became Warrenton's mayor.
Twenty-eight rfeputed Industrial
Workers of the World ana held in Jail

For an hour Policemen Phillips and
Hatch temporized with the men, whom

by- the officers, after a patrol wagon

to Jail, knives were drawn and loud
threats were voiced, and the situation

arrived. The ring leaders were held on
various charges.

strike of the Marconi company opera

cific and the Missouri Pacific railways,
via Epokane, in connection with the
Great Northern railway; via Sliver Bo'w

cific railway, and via Butte in connec
tion with the Chicago, Milwaukee & St.

rates and restriction in number of

Winfree and William C. McCulloch, Port,
land, have filed a brief before the Inter
state Commerce Commission In behalf of
Allen & Lewis, Lang A Co., Mason, Ehr
man & Co., Wadhama & Co., and Wad
hams A Kerr. Bros., complainants
against a large number of railroad com
panies. This Is known as "the candy case" in
which complaint waa filed in the fall
of last year, alleging unreasonableness
of transcontinental commodity rates ot
12.60 from eastern territories to Port
land on candles in less than carload
lots. Candy of valuation not exceeding
16 cents per pound Is classified third
class and the transcontinental tariff
named third class rates of $2.20 per
100 pounds.
The couimlalon waa asked to grant
reparation on shipments moving during
a period of two years prior to October
10, lilt, based on the dferencii In
charges figured on the If.' class rate
as against the $2.(0 commodity rate.
The case, was heard l3 Portland. January
19, 1913, before Examiner Flynn. Sub
sequent to the taking of testimony a
brief was filed by th plaintiffs, fol
lowed by a brief ot the defendants, and
now the plaintiff has filed reply brief.
It now remains for the commission to
render its decision.
The amount Involved Is about $703,
which the railroads will have to. refund
In the event that the commission sus
tains the contention ot the plaintiffs.
Since the filing of the complaint, car
riers have Inserted what is known as
the alternative application rule which
provides that either class or commodity
rate whichever Is the lower shall ap
ply on candy shipments in less than car

escaped from the penitentiary late Sat
urday afternoon and has not been recap
tured. He was a trusty and secured an
opportunity to escape while working on
the prison farm. He was sentenced
from Jackson county for petty larceny
and had served seven months of sen
tence of one to seven years.

Permits During Last Quarter

Salem, Or., May 6. During the past
quarter 114 permits, to appropriate wa-v
ter, have been issued by the state en
gineer, under which It is proposed to
irrigate 49,071 acres, develop 1551 horse
power and supply water for domestic
and municipal use, according to a state
ment Issued today by the state engineer's
office. These permits also Include 11
for the construction ot reservoirs for
the storage of 3029 acre feet In fees,
12288 has been paid the state for these
privileges.
"These permits cover some large irri
gation projects, perhaps the most yn
portant being that filed by the Oregon
Land corporation, of Portland, which
covers about 0,000 acres on the head
waters of the Deschutes river In the
vicinity of Crescent." says the state
ment. "This project covers a part of
the wagon road grant and It is the
purpose of the parties handling It to
effect an exchange with the forest
service so that the land to be Irrigated
will He In a compact body instead of
every odd section as granted to the
road company. The water tor this pro
ject will be taken from Cottonwood,
Miller. Shoestring, and Sink creeks and
entails the construction of a reservoir
at Fish lake.

Dr. Lee waa pastor of Calvary Pres
byterian church; Portland, early in the
'80s. He came to Portland & graduate
of the Theological Seminary In New,,
Tork in 1882. -He was pastor here for
six years, going from Portland to Pu
eblo. Colo. Three brothers. Rev. George
H. Lee' of Ballard, Rev. Wallace H.
Lee, dean of Whltworth college at Ta
coma, and Rev. Louis L. Lee of Cin
cinnati, survive him.
