Patrolman Hewston, After
Falling, Sends Four Bullets
Into Assailant's Body; Sus
pect Caught.
Patrolman Charles Hewston.
As the result of a revolver duel
shortly after 1 o'clock this morning at
First and Hall streets. Patrolman
Charles Hewston, a member of the sec
ond night relief and one of the emerg
ency tiquad, lies at St Vincent's hos
pital with a dangerous wound In the
groin, and J. Frank Kelley, alias Frank
Ryan, Ilewston's assailant, a confessed
highwayman, also lies at the same hos
pital, In an extremely critical condi
tion, with four 'bullets In his body. Pa
trolman Hewston fired the shots after
he had been wounded and had fallen to
the ground.
The patrolman's injuries are not con
sidered fatal.
The shooting took place on a dark
corner In South Portland, when the
patrolman encountered a suspicious
looking man and demanded to know hla
business.
"What are you doing here at this
hour of the night?" asked the police
man. Hewston says the man immediately
drew a gun, and fired. Hewston had
instinctively turned sideways to the
man, receiving the bullet In the groin.
Shots Are Exchanged.
As the policeman fell, he pulled his
own revolver and fired as fast as pos
sible at the fleeing assailant, who re-
J. Frank Kelly.
turned the fire, emptying his run at
Hewston.
Although four bullets struck Kelley,
he sped down Hall street to the South
ern Pacific narrow gauge depot, where
he crawled into a car, where he was ar
rested by Captain Keller and several
patrolmen.
Hewston was rushed to the hospital
and Kelley was brought to police head
quarters where the extent of his In
juries, which consist of a wound In the
right shoulder, a broken left arm, a
bullet in the lungs and a deep cut
across the abdomen where a bullet
grazed him, were discovered. He was
rushed to St. Vincent's hospital.
On the way to police headquarters
Kelley admitted that he held up and
robbed the Frank L. Smith meat market
on Seventeenth and Alberta streets
Tuesday night, securing $70. This
morning, however, ho repudiated the
confession In the presence of Detectives
Coleman and Snow.
Kelley Slarrled Man.
"If I die, I will take a lot with me,"
he said.
Kelley is a married man and has a
daughter who, with her mother, Is now
visiting in Grants Pbbs. Kelley has been
employed for some time by the H. -V
Norton company of Front and Clay
streets, dealers in hides. He is a miner
by occupation, and came from Missoula,
Mont., where he worked at his trade.
He Is about 85 years of age. A sister,
Mrs. Lottie Louis, lives In Vancouver!
B. C.
When It became known that Kelley
bore a resemblance to the man who has
been terrorizing Tacoma for some) time
with a series of daring holdups It was
thought that he was the "Tacoma Kid,"
but when It became known that Kelley
had been employed here for at least four
months, this theory was exploded, al
though the "Tacoma Kid" had not oper
ated in Tacoma for some time.
