Instead, Tony whipped his horse into a run, and fled down the road, regard less of ,ruts and mud holes, while the disappointed highwayman stood in the middle of the road, cursing and shoot ing after him. Tony landed at police headquarters to explain his troubles. McGinn Paroles Embezzler o. A Jackson, clmrged with embezzling JfiB, pleaded guilty yesterday afternoon be fore Judge McGinn of the circuit court and was paroled. Jackson has been in the county jail eiruie July 1 and the Judge said that was sufficient punish ment. The case fgalnst Charles J. Kelly, charged With assaulting Frank Sinclair, was dismissed by the Judge. The two men engaged In a fight "at Lents. Kelly wits indicted by the pres ent grand Jury. Meeting for Mothers. Portsmouth Parents' and Teachers' circle will hold Its regular monthly meeting at Ports mouth school Tuesday 'at S o'clock. Driver Is Injured A Northern Ex rrcss wagon, driven by Ross Murphy, was struck by an "S" car yesterday afternoon on Third street between Pine and Oak streets, and painful Injuries were sustained by the driver. Mur phy, however, managed to stay with his wagon, but was bo dazed that he was not able to take notice of what car struck him. John T. Logan on Single Tax At torney John F. Uosenberg was yesterday afternoon set free by a directed verdict In the Circuit -court, where he has been on trial on a charge of killing Vera Hall, the 20 year old girt from Oregon City, while preparing her for an opera tion. It was alleged. .Judge Morrow held the state had not Introduced sufficient evidence to show that the physician was careless or In tended performing an operation on the girl, , v., . : Another reason for the dismissal lies In the Tact that one of the most Im portant witnesses for the state went back on Deputy District Attorney Fitn gerald and told an .entirely different story on the witness stand than he has previously given. Elmer Erlckson was the witness. He Is accused of being sponsible for the condition of Vera Hall and originally said he took her to the office of Dr. J. J. Rosenberg for the operation.. He had also been her sweet heart for three years. On the stand, FJrtcksori said he went to the physician's office with the. girl, because she had the nose bleed. He denied knowing her condition. - 1 Acquittal Ordered. , Attorney George Stapleton and Ralph Moody asked the court to direct the Jury to return a verdict of acquittal Thursday afternoon when the state closed its side of the case. Arguments continued until late yesterday afternoon, They contended the state had failed to show the physician was either negligent or contemplated an Illegal act. Deputy District Attorneys Fitzgerald and Collier argued that the accused was culpably negligent, in that he admin Istered chloroform without taking the proper precaution and that he was pre paring to do Van Illegal act, and while preparing for '"this aot caused the death of the girl The mother of the girl was the only witness that gave any testimony tend ing to Show that the physician knew the condition of the girl, and that he had given her chloroform. The mother said Dr. Rosenberg told her he -had .given her daughter an anaesthetic and It had not worked as he expected It to do. He further told her Hhe girl came to him Jordan .operation,, she said. Erlckson originally told the same story, but when placed on the witness stand denied knowing anything about it. If he would have kept to his story the testimony of the woman would have 'been oor roboeated and the state could have t one ou, with 'tire case. Evidence Hot Sufficient. Judge Morrow said: "The rule Is that an inference cannot he based upon an inference. As the evidence now stands we have first to infer that the physician knew the condition of the girl and then we have to Infer he intended an opera tion. There Is n'6 testimony that he knew her condition. The evidence does not show that any unlawful act was committed without due caution or cir cumspection, or tend to prove any un lawful act whatever." Attorney Moody asked Judge Morrow t cite the several newspaper reporters to appear before him and show cause why they should not be punished for contempt of court in writing certain ar ticles about the physician. The at torney said the articles tended to poison the public mind against the doctor. The court said he would think about the matter. Warning against a HO National bank note, so skillful a counterfeit as to make it unusually dangerous, has been re ceived by United States Secret Service Agent 8. A. Council from headquarters at Washington. The note Is. said to deceive even experienced , money han dlers, being distinguishable' only by the thickness and length of the silk fiber. . ' . The note Is on the National Bank of Commerce of Wichita, Kan., the series of 1882-1908, signed by j. W. Lyons, secretary of the treasury, and Ellis H. Roberts, treasurer. Its issue number Is 639,133. The report on the note states that the counterfeit Is evidently made from photo-mechanical plates", printed en two pieces of paper with silk threads, too long and thick to be genuine, between. Another distinguishing feature of the counterfeit is that the hand of the female that grasps the lighting flash appears to be maimed, the fingers ap parently being cut off at the middle Joint while the genuine notes show the closed fingers well defined. BoJUnger of the Highland Congregational church told the church members at the close of the Thursday night prayer meeting this week that it was the sliver wedding anniversary of himself and Mrs. Hol llnger, he did not expect on goln& home a few minutes later to see all the house lights flashed on as he opened the door and to find numerous friends and mem bers of the church awaiting Mrs. Bol linger and himself. After congratula tions, C A. Mann made a felicitous ad dress, and In closing said: "Tour friends undertook to bring as many silver dollars as the occasion rep resents in years, but they lost the count somewhere."
