a shipment of cattle ( from Plymouth,

than 18 hours. In violation of the fed
eral law. Evidence In - the hearing I
showed that the cattle had been turned
over to the Northern Pacific Terminal
company in Portland, for delivery to the

stead under the laws of Oregon. Judge
Oatens' decision on this question ex

trary to the Idess of many attorneys,
and Judge Bronaugh, In -passing . on
the Question thts morning, said he had
shared a contrary opinion before ha
made a close examination of the authorities.

council to regulate liquor trarncwere
annulled by the vote of the people of
Lane county, and that Kuthe, being ar
rested for violation of a city ordinance.

G. S. Sch warts, arrested several days
ago by Deputy Sheriff Sweeney ana

of J. IV Sneve, , who is suing him for

was about to leave the state, has sued
out a writ of habeas corpus in the cir
cuit court and Judge Bronaugh will
hear the matter tomorrow.
Schwarti alleges that his situation It
virtually an Imprisonment for dent, in
violation of the constitution. Nothing
but a civil suit has been filed against
him, ana he claims that he should be
released. s
Schwarti and Sneve had their deal
ings in Marlon county, and Schwarti
left Silverton about 2 o'clock on the
afternoon of December 16. leaving in
structions for his baggage to be sent
to Portland after him. Sneve says that
Schwart drove from Silverton to Che-
