B. S. Josselyn, president of the Pert land Railway, Light & Power company, has made a detailed statement of the position of the company In regard to the controversy over tne city jignung now being carried oh between the company officials and the mayor. The statement is as follows: "Section of the present charter of the elty of Portland reads as toiiows; " 'Section 6. The city of Portland Is One of the Essentials of the happy homes of to-day is a vast fund of information as to the best methods. right living and knowledge of the world's best products. Products of . actual excellence and reasonable claims truthfully presented and which have attained to world-wide acceptance through the approval of the Well-Informed of the World; not of indi viduals only, but of the many who have the happy faculty of selecting and obtain ing the best the world affords. . "It Is our interpretation of the charter that the city cannot In any wise be .bound to pay for lighting unless it Is by contract authorized by ordinance, and further under a contract made from bids. This being the case, we do not see how the executive board of the city, or any other body, officer or agent, can bind the city without a contract for the fiayment of any sum of money exceed ng 10. A contract cannot be let un less bids are advertised for 60 days. "The executive board has the bid of the Portland Railway, Light & Power company. In accordance with, the ordi nance and charter, for a period of five years from January 1, 1909. which has not been accepted nor rejected and is still operative if the executive board wishes to act. , "In order that the public ir.av be fully advised, the companv has of Its own accord extended the time of making new contract until jnnuary 10, at which Ume if new contract is not made in ac cordance with city charter, the eompanv will be compelled . to turn off the cltv lights. ( , 'The provisional price made this cltv for street lighting Is at the rate of 153 per arc lamp per ear. It Is interesting" to note that the rare made per arc lamp in New York City -is $90 to 1100; Phila delphia. J99-60; St. Louis. $97.60; Bos ton. $114.10: Cleveland, $67.22; Cincin nati. $60;. Baltimore, $67,49; Pittsburg, $76; Washington. $86; Detroit. $62.83; Buffalo, $56. The reason for this low rae in Buffalo is oifaccount of power being derived from Niagara falls, onlv 10 miles distant, whereas th power for the operation of arc lights In Portland Is mainly generated at Cazadero, 40 miles distant; the greater the distance from the point of generation to the Jiolnt of consumption the greater- is the ineJes of - electric -current In .trans mission, which has te be overcome by a corresponding higher rate to con sumer. "It will be observed that the bid for city lighting wade by the Portland Rail way, Light & Power company is lower than that made any of the other cities mentioned except Buffalo, -and should form a very good opinion of the low rate made by the local company. ' "It Is understood that the gas com pany would not bid on city lighting for a period less than 14 years on account of the cost of extending gas mains, whereas the city eliarter only permits the letting of a city lighting contract - - - - . . i for a period not exceeding five years. "The Portland Hallway. Light & Power company, for the same reason, cannot enter into a contract for a period of less than five years, and install ad ditional street lamps, on account of the cost of Installing these lamps being greater than the rental for a period of two and one half years. On a five yar contract all new lamps Installed in the last two and one half years would be a direct loss to the company. "Inasmuch as requests are now In for about 125 additional arc lamps, if we enter into a contract with the city for aeperlod of less than five years, we could not Install any additional lamps and receive anv return on our invest ment. VW-e maintain that until another ordi nance is passpd by the citv council, and bids have been advertised for 60 days, the executive board is powerless to let a contract for city lighting except for three or five years as specified in the ordinance; anl Inasmuch'- as the com pany cannot take a three year contract and install new lamps, it means that either a contract must be let for five years and new lamiis installed, or for three years without being required to install any additional lamps.
