Per Cent.-Pure. u TMETFOR J. A. Seeber, Teamster, Fires Two Shots at 6. L. Daven port, Commission Man Dispute Over Trivial Mat ter Nearly Causes Tragedy. George Davenport G. L. Davenport, a commission mer-'j chant at 144 Front street became the taraet for two bullets fired at him by J. A. Seeber, a teamster, this morning. Davenport was but five feet from Seeber when he saw him pull the revolver from his pocket, but as the commission man turned and ran quickly, he dodged both bullets. Seeber remained on the scene, and had the gun still in his hand when the patrol wagon arrived and was arrest ed by Officers Harms and G ruber. He waa locked no on a charge of assault and attempt to kill. Seeber, according to Davenport, In-I sisted on unloading wood in front of Davenport s store early tnis morning. UavenDort savs he told the teamster as It was not his wood to unload it farther along the atreet. Seeber called Davenport a vile name and repeated it when remonstrated with by the com mission merchant Then Davenport knocked him down. Seeber left the vicinity of the store. but a few minutes before 9 o'clock Dav enport looked up and saw seeDer stana lng near him. At that Instant Seeber whipped out the revolver he had evi dently gone away to procure, and as Davenport turned on his heel and ran Seeber fired twice, but missed. Seeber, who is 70 years of age, de clared after his arrest that he could not bear the Ignominy of being knocked down and struck in the face, and that he had brought the pistol from his home to a-et revenge for the blows struck by the commission merchant He will appear tomorrow in the municipal court 36000. The nronertv of the threshing machine company was assessed at $23. 000 and the board rut the assessment down to $20.000. but the corporation waa still dissatisfied and asked for another reduction of $6000. An ordinance drafted by City Attor ney KavanauKh for submission to the city council this afternoon will, Mr. Kavanaugh thinks, relieve the confusion caused by the recent decision of the supreme court in the vehicle tax case, relative to the Influence of the referen dum upon all legislation. According to that decision, no ordi nance passed by the 0117 council be comes effective until 30 days after Its Sassage. The charter provides that or lnances shall take effect at the expi ration of 10 days unless the mayor dis approve. xs ciiy attorney provides in nis Dill that the time for the Invocation of the referendum on city ordinances shall be limited to 15 days after approval by the mayor, or within the same time after a veto has been overruled. In event the mayor neither approves nor disapproves an ordinance within 10 days, then the time fixed within which the referendum may be invoked is also IS days. -Authority for the passage of the rem edial ordinance, says Mr. Kavanaugh, is given in tne state law, which pro vides that exceptions to the 80 day rule may be made in cases of emerg ency.
