Asserting that Its privilege of handl ing; streetcar advertising In Portland Is not "merchandise." and that It pos sesses ' no stock that can " be called merchandise, the Pacific Railway Ad vertising: company has tiled a notice of appeal from the action of the county board of equalisation, Which last week refused to expunge or lower an assess ment of 120,000 for the present year. County Assessor Slgler ascertained that the company paid $20,000 for the exclusive' privilege of .handling the ad vertising In the streetcars In Portland. He held that' the company should be assessed for that amount. But how was he to describe the thing to be assessed? It is not a franchise, nor real estate, nor 'could It be defined as money, notes and accounts. Apparently the com pany's property ; had to be listed as "merchandise,"' though the most of Its value la intangible. When the time came for filing pro tests with the county board of enualtza tlon the advertising concern presented a long application for cancellation of ita assessment. It declared, in sub stance, that what merchandise it owns is carried in San-Francisco, and that It has no taxable property in Oregon, except Its office furniture. But County Judge Webster, Clerk Fields and Asses sor Sigler . would not concede that the assessment should be stricken off, and the 320,000 figures remain ,4on the books. Await Court's Decision. It was clear . that if the company had invested $20,000 here In land, build ings, jewelry, hardware, groceries, or in almost any other conceivable form. It would be takable on that amount. Then why, It was argued, should ,it be allowed to escape without paying a cent on its investment? Now that an appeal has been taken, the matter will go into the circuit court for Judicial determination. There is apparently little doubt that the courts will cancel the assessment and rule that the privilege of advertising here Is not merchandise. County officials are apparently not sanguine that the courts will uphold the assessment, but they hope that the weak spot thus re vealed in the law may be remedied by the next session of the legislature, O. B. W. Will Hot Appeal. A. C. Spencer, representing the O. R. & N., has stated that he will not appeal this year from the assessment, which was reduced by the equalizers from $14,400,000 to $2,700,000; The assessment Is not quite as low as the railroads wanted, but the company is fairly well satisfied. Tomorrow will be the last day for filing notice of appeal from the action of the board' of equalisers. It Is thought unlikely that other appeals will be made unless they come from some of the big Implement companies, which were heavily assessed on money, notes and accounts. These firms claim that their notes and accounts are col lected in the east and should not be assessed in Oregon. ENGINEER ON MISSING LIST Lew Weatherford, 808 First- street, a river steamer engineer, who has lived In Portland many years, has disappeared. The last seen of him was last Sunday, when he left home, skying he would soon return, Mrs. Weatherford fears her husbandries committed suicide. He had been out of work for some time. Weatherford telephoned to a friend last Sunday afternoon, asking her to tell his wife that he would not be home for a few dttys. He said he was In Ore gon City. . An investigation was made and the telephone company reported that Weatherford had been In Vancou ver, Wash., when he had telephoned to Portland. The police In Vancouver have befn asked to keep a lookout for him. Weatherford is six feet in height and 61 years of age.
