C Bayer and Peter Hobklrk In Judge Cleland's department of the sir cult court yesterday afternoon. Some time ago Smith secured judgment for $190 on a note, but a new trial was ordered by the state supreme court The note was originally given by the de fendants to the Concordia Loan & Trust company, for which J. Thorburn Ross was agent,' and Ross was one of the im portant witnesses. The trial occupied two full days. That J. H. Truby, ex-assistant cashier of the Oregon Trust & Savings bank and at present a member of the brokerage firm of Cook & Truby, and who was stricken with an attsck of heart failure last Monday, will recover is the word f lven out at the Crystal Springs sani arlum where he was taken shortly after the attack. For a time It was feared that Mr. Truby might not rally and that the attack would prove fatal, but the dootors stated this morning that he was feeling much better and that be will soon leave the sanitarium. Joseph Weloga, 1 proprietor of a sa loon at Sixteenth and Savior streets, was fined $25 by Judge Van Zante this morning for selling liquor to a man already Intoxicated. Several saloon men have recently been arrested on this charge, and in almost every Instance a rather heavy fine has resulted.
