At yesterday's meeting of the atreel
committee of the city council the mem
bers referred the petition of property
owners residing on Kllllngsworth ave
nue asking for the widening of that
thoroughfare from 6ft to 80 feet to the
city attorney for an opinion as to
whether the fact that more -than 8 mile
of hard surface la being laid on the
street would be a bar to the wlshea
the property-owners. Members of 'the
committee fear that If the atreet In
.widened the contract with the pavlnc
company would be rendered void and
referred the question to the city attorney.
. Unkind names and ungentle treat
ment are accusations made by Bessie
E. W. Dean In a suit for divorce from
Joseph W. Dean, filed In the circuit
Introduction ,f an ordinance by Couhcll-
;nn Kenaiier ordering that all nign
pressure wires of the company on Haw
thorne avenue be placed underground
before the proposed hard surface piwe
ment from East Third street to East
Fifty-fourth street Is laid.
Hubcr said that his company would
not put the wires underground and that
the council can do whatever it wants to
In the matter. Further he said that
even If the question were put to a ref
erendum vote and decided against the
company the wires would remain above
fround.
Ki'lUher did no seem Derturbed over
Huber's statements although ho replied
with some, heat that if the eompany did
not put Its wires underground on Haw
thorne avenue the people would vote
n. xt Junt to 0,11 1 all or the company's
wires In all parts of the city under-
f round. Still Huber remained firm In
ils declaration that the company would
not put the wires underground.
Huber contended that It would re
quire two years to place the wires un
oerground and Kellnher replied that the
work could be done In six months. City
Engineer Taylor said that six months Is
a little too short and two years a lit
tle too long; when asked for his opin
ion. The committee refused to recommend
the ordinance for paasage and Kellaher
threatens to bring the matter up before
the council next Wednesday. Kellaher's
resolution to revoke the franchise of the
Portland Hydraulic Elevator company
was referred to City Engineer Taylor
and City Attorney Kavanaugh for a re
view of the facts In tho matter.
The hydraulic company's , franchise
Is owned by the Portland Railway.
Light Power Co. and shortly after Its
purchase discontinued service to its
patrons, whom Kellaher claims were
forced to purchase electric motive power
from the railway company. Kellaher
contends that Inasmuch as the company
Is not operating. Its franchlae should be
revoked. Huber asked that this matter
be laid over for two weeks until 'the re
port from the city engineer and city
attorney could be received, which was
done.
