An alleged brutal assault on a woman
by a real estate dealer who had locked
her out of her own house, and the

K. H. Dufur. attorney (11 Mrs. New-
comb, says that some months ago T.
Newcomb the woman's husband, con
tracted with Wllkins for a lot and the
erection of a house upon it. He paid
down about $300. the balance to be paid
In installments and was to work as
carpenter for Wllkins, part of his wages
to go toward paying for his house
and lot.
About two months ago Wllkins asked
to be allowed to take the contract to
his office to copy it. He never returned
it. although he alleged In court that he
had done so. He brought an action In
ejectment against the Newcombs, but
lost the case, which was non-suited.
ltecntly Air. Newcomb went to east
ern Oregon to work, one day when Mrs,
Newcoinh had stepped out to see one of
the neighbors, Wllkins got Into the
house, locked the doors and refused to
let her In.
She went to her attorney, and acting
Municipal Court Clerk Will
Issue Warrants Only

John T. M liner, the clerk of tho court,

rant no warrant will be Issued. And If
the district attorney's office declines to
Issue a complaint. I will make out a
warrant if (lie facts Justify doing so."
On the other hand, lilstrlct Attorney
ameron said at noon that before the

.ante regarding the clerk's policy. He
declares that according to the law the
lerk, who Is only empowered to admin
ister oaths, can do nothing olse than Is

Latimer was shot accidentally by
Hilly Martin of McMlnnville. with whom
he was out hunting. I.atiiner shot a
grouae and walked around a small sand
dune to pick It up. Just as he raised
UP another grouse flew' and Martin, not
suspecting tnnt his friend was so near,
fired.
, Latimer received the full charge of
shot In the breast. I.atlmer walked n
mile to camp, assisted by Martin, where
Iir. McKay of Portland, who was camp
ing there, dressed 'he wounds.
San Francisco, Aug. 19. The cruiser
s.iiadron, constituting the Pacific fleet,
is assembling here today In preparation
for Its voyage to Samoa and return.
I'nder command of Hear Admiral Swin
burne the ships will depart Monday
morning, and will first visit Honolulu,
arriving there September 2. The tor
pedo flotilla, which will be towed by
the bigger ships on the trip, is expected
to assemble in the harbor tomorrow.
With the exception of the Colorado,
which was recently damaged by run
ning ashore In the straits of Fuca, and
will be laid up for repairs, the entire
Pacific squadron lies nt anchor here
ready for the three months' voyage. It
will remain at Honolulu a week, will
arrive at Pago Pago, Samoa, September
20. will leave there September 27, and
will return by way of Honolulu nnd
San niego to Mngdalena bay, wdiere they
will arrive November 1 for target prac
tice. Thev will be back at Ran Fran
cisco Iecember 4.

klns. a civil engineer, reputed to have
wealthy relatives nt Cincinnati, Ohio,
shot himself to death in a Tacoma
rooming-house at nn early hour this
morning. No cause for the self-murder
has been ascertained.
In closing

This step was deemed advisable by
Dr. I'ohl after carefully considering the
present situation. Smallpox has been
prevalent throughout the country for
several montlis in a mild form und cer
tain cltlaens object most strongly to

The health department lias patiently
contended with this attitude as long
as It could without endangering the
public health, but a sweeping change is

the quarantine aro discovered and In the
event of persons falling to report a
case of smullpox.
As a beginning in the new arrange
ment l)r. pohl this morning swore to a
complaint charging I r. James K. Jew ell,
an osteopath residing at 41ti lllbbard
street, with falling to report smallpox
In the family of Mrs Mary Jewell, a
relative, and living at 960 Kast Twenty
sixth street north.
Mrs. Jewell and her daughter, Jllss
IIultlB Jewell, were afflicted with the
disease following the Illness of a small
son who was also a victim of smallpox.
11 Is said that J11. Jewell was called In
and he Is alleged to have diagnosed the
Illness as stomach trouble. He made
no report on the cases. I.atijr Dr.
tleorgn H. Stovull was called In 'and he
at once pronounced the disease as small
pox and reported It to I r. I'ohl.
The health officer Immediately visited
the house and found both Mis. Jewell
and her daughter suffering with small
pox and placed the house under quaran
tine. The small son was not in tho
house w hen I r. I'ohl visited the place
and was doubtless running about with

A woman whose husband choked her
because she would not talk was brought
to light in tho circuit court this morn
ing. She Is Mrs. Amy Deacon, wife of
John G. Deacon, and she told It her
self. She was on the witness stand In
Judge Morrow's court, seeking a divorce.
Mrs. Deacon volubly explained that
she Is a woman who don't talk very
much, still talking so rapidly that her
attorney cautioned her to speak more
slowly, so she would he belter under

mildly chatting with a woman friend
her husband ran around the house like
mad nnd then abused her. localise she
had nothing to say to him. Mrs. Dea
con also testified that her husband
had made false accusations against her
for the purpose nf starting her to talk. I

were married in Buffalo. N. V.. in
