In an opinion filed with City Auditor
Barbur this morning. Deputy City At
torney Frank S. Grant held that the
ordinance recently passed, by the city
council requiring property owners to cut
and remove glass anil weeds exceeding
10 Inches In height from all property
within 120 feet of an Improved street,
cannot be enforced.
Ilia opinion was made at the request
of the ponce committee of the cltv
executive board. According to the es
timate of the police commutes ttin city
would have to spend about $10,000 each
year to carrv out the provisions of the
ordinance The opinion follows:
"I have vfuir favor enclosing the re.
port of the committee on police on
ordinance Xo. lX.OuS, together with a
communication from the chief of police,
all lelHthig to the cutting anil removal
of weedH it n ,1 (;niHN from private prop
erty and making the coat of removal a
lien on t ho property.
"After n careful consideration of this
ordinance I flint several serious objec
tions to It. The first objection Is that
the fund out of which the expense of
cutting these weeds Is to bo paid In the
first Insianco by the cltv Is not desig
nated. I'lin second objection la that no
notice Is required to be given to the
property owner, and 1 am or the opinion
that the city, before It could place a
Hon upon the property for the cutting
of grass and weeds should first re
quire a notleu of some kind to be given
to the property owners The next ob
jection s that the ordinance provides
that a lien ugalust any lot shall be en
tered in the docket of city liens, and
when so docketed shall be collected In
the same manner ns assessments for
street improvements are collected, or
the same may be collected In any other
manner ns the council of tho city of
Portland may direct.
"I am of the opinion that the ordi
nance should prescribe a definite mode
f enforcing the collection of a lien
and not prescribe one method In the
ordinance Itself and leave It to the
council to prescribe another method. In
other words, one method and one method
only, should be prescribed. Another ob
jection is that no provision is made af-
nronertr
that the ordinance

but non-resident DroDerty owner. You
tra arivl,l tita, in mv tinlnlnn the or-
dlnanre in Its present condition could
not be enforced.
"Ordinances of this character have
been held dhnatltntlnnal as a DroDtr ex
ercise of the police power and under the
provisions of our charter thara la ample
authority for the council to rasa this
ordinance. In fact It la made the duty j
