Alleging that curious points in the California pure drug and nnti opium laws make them unconstitutional. L. E. Dadwell of Pan Plogo, attorney for J. I.. Hallawell. a druggist of that city, has applied to the supreme court ot the state for the release of his clients from technical ar rest Incurred bv the alleged violation of the law by selling laudanum containing more than two grains of opium to the' ounce. Hallawell sold th? laudanum without prescription of a dentist, physician or veterinary surgeon, so as to test the law. His lawyer sets up the point that the law does not prohibit the giving Bway of drugs nor the dispensing of them. He further contends that the law Is against the public welfare, as a man mav be 111 and not be able to ob tain a prescription .nt once.
