fice of the Butte Boys Consolidated
Mining company yesterday from their
foreman at Goldfleld. ; This message will
be glad news to the many stockholders
' Who have held on to their stock, even
- when tempting offer have been made
them to part with It, The office of this
company has been bustling with activity
'the last few days making happy the
eager applicants who have been rushing
In to procure an allotment of stock.; At
the present rate of subscription the
stock will remain on the market for
about three days and then be withdrawn
for good. Enough money Is being
raised at this time to make the mine a
shipper, so that it is barely possible any
one will ever be able to purchase Butte
Boys treasury stock after the middle of
next week. The foreman writes that
the farther tinder the hill they get the
. better grade of ore they get. There is
lota of excitement over their lease on
s the Florence claim. There have been
two immensely rich strikes made In the
last week adjoining the Butte Boys
lease. The Butte Boys have started work
from the 600-foot, level and will push
.work night and day. Their engineer
thinks there will be no question about
them getting shipping ore In "a very
short time. The company is now work
ing three mines the Original Butte
Boys, the Night Hawk and the Florence,
: and to use a vulgar expression, they are
making Borne howL Ji? ,;.!
The first step In an appeal In the case
of Charles W. Walton, convicted on his
: fourth trial of 2 ahootlng - Patrolman
Olaus Nelson, will be taken this after
noon. His attorneys are preparing a
motion for a new trial to be submitted
to Judge Cleland, numerous exceptions
having oeen taken to the rulings of the
court during the trial. If the motion
for new trial Is denied notice of appeal
will at once be given and another long
fight for freedom will be under way.

D. 8. pufur, sued in the circuit court
for $485 by V. S. Hardy, has come back
with - a claim for $10,810 damages
against Hardy. He la the Inventor of a
. typewriter aevice. : ne says, ana iiaray
agreed to - exploit and advertise his
genius. He says he spent $910 to aid
Hardy on the "booming" end of the Job,
. but that Hardy employed a mechanlo to
make changes In . the Invention so It
could be manufactured without payment
of royalty to the Inventor, Dufur asks
for SlO.OuO for this alleged betrayal of
trust, and also the return of his tlo.
His demand is made in an answer and
cross-complaint placed on flle yesterday.
The Ancient Order of Hibernians will
have their annual picnic tomorrow at
Cedar park,5 near St. Jehns. Members
of the order and their families to the
number of about one thousand will be
at the grove where a dinner will be
served by the Ladles' Auxiliary of the
order. A fine program of sports has
been arranged for the afternoon. This
includes races of all kinds. Fat men's
races, lean men's races, three-legged
races and novelty races galore. The
sporting committee will give the win
ners valuable ., .prises. Special events
for the boys will be the leading feature
of the program,
On a vacant lot. on the west side of
Michigan avenue near Fremont is a tiny
shanty that has been erected by the
boys of the neighborhood and here a
throng of young hoodlums congregate
to smoke cigarettes and drink bad whis
key. Patrolman Llllls reports that the
frequenters of the shanty range in age
from 8 to 22 years. The police will
break up the crowd. .
J. C. Sill was granted a divorce from
Marguerite Frances Sill by Judge Can
tenbeln" yesterday afternoon on the
charge of desertion. They were mar
'rlPd in San Francisco in September,
1898, and the wife alleges that she was
abandoned in the California metropolis
10 years later. The plaintiff was
.granted custody of his two boys. It and
eight years of age.
E. A, Holcomb, executor of the will
of James Wilson. , ha 'made his final
report to the county court, showing
that $20,455 has been distributed to tho
heirs. Telitha J. Wilson, the widow,
receive $7,000; Mary-C. Peter $1,600,

Alex D. Ross, whose brother is John
M.' Rosa of , Washougal, Wash., has
been missing since June, S3, when he
Inquired his brother's address of George
Burns, S84 First street, and the brother
has asked, the aid of the police in find
ing him. ' Alex Ross Is described as
81 years old, weighing 185 pound and

yesterday when George F. Dashlell died

Within five year all the theatre
in Portland will have to be boused in
brick buildings if the plans of Build
ing Inspector Dobon are carried out.
Mr. obson ha under consideration an
ordinance "providing that all theatres
operating in Portland must be of brick
or stone, preferably fire-proof construc
tion and will present it to : the coun
cil in the near future. - r .
At present the only hrtck theatre
in the city are the Marquam and the
Pantages ; reconstructed house. . The
Helllg is a staff compoBition and the
others are all frame buildings. In or
der. to work no hardship on the-owners
of the theatres, however it is proposed
to give them five years to get into new
and safer quarters. The Helllg and
the Baker are already looking around
for sites for new fire-proof nouses.

Some weeks ago the management of
the Grand asked to make some altera
tions ana enlargements. , -

withdrawn but the. committee wa sent
over to inspect the house. It reported

eral changes including alterations in
the sprinkler system and the electric
wiring. At Dresent the snrlnklera In
the basement are only ander the stage
and the portion of the basement under

tected. In order to nrotect the audi
ences the committee ordered that the
sprinkler system be extended through
tn entire basement.
The wiring was found to be in bad
condition, according to the report, and
there are Jong distance of loose flex
ible wire. These were, ordered cut out
and the wire were ordered knobbed
rigidly, every four feet. The rest of
the house was found to be in good con
dition excepting -that the committee
again registered a remonstrance against
theatres In frame buildings. -
At present there is no city ordinance
frotecting people from overcrowding in
he theatres excepting that providing
that everyone shall have a feW and a
half 'of floor apace. - Chairs are not
allowed in the aisles, but as many per
sons a the houses wish to admit can
be crowded down them, provided they
are standing, and - that the foot and a
half of floor space per person is pre

Dr. Riley spoke last night from the

Power company, the Japanese govern
ment has turned over a newly completed
2,500 kllowat generator to the company
for Immediate use t the wrecked Caa
dero plant The big machine wilj be
rushed by a special train from Scheneo.

This is the first machine to be e
cured by the Portland Railway, Light
& Power company to take the place of
one of the three generator self-destroyed
at the company' Cazadero
power house. The company's agent
scoured the country for day, and could
not get trace of a large generator that
could be , immediately available. Yes
terday a 2.100 kllowat - generator Just
ilk those lost in tha Casadero disas
ter was found as it wa being chipped
to Japan. Tbe company got into cable
communication with the Japanese gov
ernment, and promptly received advice
that it could have the machine. The
wires were kept hot by President Josse
lyn and among his old friends of the
eastern railroad managements it was
quickly . arranged that a speed trial
would be made to get the generator to
Portland in the least possible time.
At Cazadero the wreckage is being
removed from the power-house, and
repairs are being rushed, to put every
thing in readiness to receive th mi
china,' and get it into Instant opera
tion. The company i anxioua to get
in a position of preparedness for any
accident that might happen to It re
ma! nig power plant.

the wrecked -set ' wa twisted off a if
it were a candle. A new shaft 1 being
forged at the Bethlehem Steel com-
fany' plant at Bethlehem, Pa., and

The shaft will be made from a solid
butt and will be 18 Inches in diameter
and 24 feet long, a sise too large for
any steel company to carry in stock.

other generator that can with com
alterations be utilized at Casadero. This
Jenerator also baa been made for the

started on two new generators for the
Cazadero plant on plans specially de
signed for this company, but week will
be required to construct them.
