Patullo held dlf ferent opinion yesterday afternoon In regard to letting contract for city improvement work all due to an Iron bound rule which, prohiblta letting blda for more than 10 per cent -of the city engineer's estimate. The controversy arose over the Improvement of Stark street between Seventh and Uurnslde with a bltullthie pavement. . City Engineer Taylor and Mr. Sabln contended that the contract should be let in this Instance although the bid was 11 per cent In excess of the city engineers estlm'ate. Mr. Taylor ex plained that his estimate was made I months ago and that the company's oia or xio.zzz wouia not oe iv per cent in excess of Jii estimate for the work at the present time. Mayor Lane Insisted that the rule be followed saying that it would not be fair to demand one thing of one con tractor and" not of another. Finds Itself Up Against It in Improv ing Streets. That Portland - la . in the hand of trusts when -It-comes to the matter of street improvement was the state ment of the members of the street com mittee of. the city executive board yes terday afternoon. Between the devil and the deep', blue ,sea 'is .the way the situation ha been expressed because the city has "to contract with either the Warren Construction company or the Barber Asphalt company. Both corporations are raisins- their bids gradually until the amounts in variably exceed the 10 per cent rule of the board. To offset this encroach ment upon the city treasury the mem bers have decided to refuse all such bids. But to do this means holding up city street improvements. Either altow the work to drag along Indefinitely or accept the bid of the trusts Is the position the board finds Itself In. To this end the nronosprt fill On East Madison street was referred back to the city council because the bid was excessive. Work on the Oak street pavement between Second, and Third streets was held up until the Barber company can secure the nn- sent of two-third of the property own ers.
