Liouor Mav Be Sold on Fair Grounds Evan Though Che mawa Precinct Voted Dry. CANNOT CONTROL THE ACTION OF BOARD John Manley Charged with Tak ing Weapons Away from Special Policeman. " (Special Dispatch to The Journal ) Salem. Or.. Nov. 17 In ease the leg talature paeeee an act appropriating money from the general fund to the common achool fund, to liquidate the mortgage of 11.800 held by the aute land board agalnat the fair grounds, the state fair will run naxt year Just aa usual, only with even brighter pro' pacta for a great ezposlUon. and pos aibly one of two weeks duration. The usual privilege of selling liquor, and the pool privilege at the grand atand. will tie aold by the state board af agri culture, and unless something unfor aeen occurs the , fart that prohibition was passed by a popular vote In Che mawa precinct. In which the flr grounds are situated, will have no ef fect. President W. H. Downing of the board was In the city yesterday from his home at Shaw, and apent most of the day conaultlng attoruaya and' gain-, log legal opinions regarding the matter. Hon. Tllmon Ford of the law firm of Ford. Kaloer At Slater has thoroughly Investigated the question since the an nouncement of the probable effect of passage of prohibition gin Chamawa pre cinct, and he la of the opinion that Chemawa precinct cannot control the actlona of the etate board, or say what may be done or sold on the fair grounds, since the board was granted the priv ilege of selling licensee for the salcfof any article for a period of 30 daya etch year, the money to go Into the treaaury of the board. Ford goes further and says that no special law. passed by the legislature, can be superseded by a general law. enacted by that body, or by the people of any precinct It would thus be nec- oaasory for the legislature to dlreetly re peal the act of 101, granting apeclal privileges to the board, if liquor la not to be sold on the state fair grounds. President Downing snd the other members of the board are Jubilant over the new turn of affaire, as it will In sure an Income of practically 12.000 a year, which would otherwise be lost. Since the discussion has arose, many people have expressed themselves aa be ing opposed to tne saie ui uquur in the grounds, and say they believe the general' public would prefer to have the legislature appropriate 12.000 extra to nil the deficiency, but unUl this la done the board does not feel like waiving the privilege unless compelled to. Charred With Assault. John Manley, a resident of South Salem, will today be required to answer to a charge of assault and battery In the police court, the charge having been preferred against him yesterday by Po liceman J. H. Penland. It la said that Penlund was knocked down by Manley, who, relieved the officer of hla billy and revolver and delivered them to Chief of Police Gibson. Will U Probated.
