The other drivers were soon cowed by a display of the police star and the trouble was ternporsrl'.y averted, but It may break out et any time, according to the state ments of several who are familiar with the pat record of the combatants. CURIOUS CHANCE SETS HIM RIGHT NINE POLICE STARS v ; MAY SOON FALL Th resignation of Policeman Fred Mallett has caused much talk among the members of the police department. . It Is asserted that a majority of the . patrolmen do not like their chief, and that more resignations -may be looked for. The officers claim that when they make an arrest they cannot tell whether or not the prisoner will be In court the next day, as the chief may have released him In the meantime. Another cause of complaint is 'the . manner of the chief towards his men. ' Almost Invariably they are spoken to so gruffly that most of the men fear to go into his august presence. The iron-clad rules and regulations regarding the new suits is another ground for dissatisfaction The mili tary cape Is regarded by pStrolmen of experience as a howling farce, an article utterly useless for police duty. The patrol wagon drivers have succeeded in convincing the chief that the cape will be useless to them, so they will be per mitted to wear the ordinary rubber coats. Another cause for discontent is the recent ruling of the authorities that the patrolmen cannot "accept money which they earn while off duty. It has been ordered that such sums must be turned Into the relief fund. - The resignation of Patrolman Mallett Is the third within two weeks. the4oth ers to hand in their stars being Austin ana aabriei. i aia onject to turning in money l earned, while off duty, because I re garded It as a rank Injustice." said well-known officer, "but I obeyed the or der rather than quit my Job, as Chief Hunt said I could do if I didn't like It. But things have gone pretty far and if they get much worse I won't stand It. I know other patrolmen are of the same opinion hh myself " The fact that Chief Hunt did not de liver an address to the men this morn ing Js regarded as peculiar. This is the first time in weeks that the chief has not lectured the patrol on police matters. To say that the men were surprised is no tnore than true. What will happen next they are conjecturing. It was noticed that the chief was very nervous this morning. Deserted by his wife, wWo was stolen by a colored msn, and deprived of his little daughter, J. J. Murchlaon. s well known rancher living near Summervllle. Or., came to Portland yesterday to se-k his recreant spouse snd to get his child. Mrs. Murchlson. as stated In the dis patches last week, is said to have left her home. In the company of "Nigger" Tom Johnaon of Portland. She took her little girl with Jier. The police were notified to watch for the couple. Saturday the officers located Johnson and he was taken to the station. How ever, he wss not locked up. as there wss no warrant for his arrest, a tele gram' from the sheriff at Ia Grande asking that tha couple be located. Sun day Patrolman Roberts found Mrs. Mur chlson in the Red Front lodging house, 2i North First street. There wss no warrant for her so she was not held. By a curious coincidence Mr. Murchl son went to, the Red Front for lodging last night. 'By a still more curious freak of fate he was assigned to the room which hsd been occupied by his fugitive wife a few nights previous. This morning he picked up a pin which he recognised as her property and when he sought the advice of the police this morning he learned that she had been rooming at this place. After being In terviewed by the officer the woman be came frightened and changed ber quar ters. The officer's gave the husband what In formation they had and he started out to find his wife and child. President Hsrrlman directs that all lands unpat ented In Nevada, belonging to the Cen trai Pacific, be patented. Just why Is not known, as attorneys say the title Is good under an act of congress. New methods, however, are being injected into the land interests of the company, not ably the withdrawal of timber holdings in California. A recent offer from the timber trust was declined by Harrlman who is of the opinion that the lands will greatly Increase In value before long. The Jury trying th case consists of Samuel Connell, Gilbert 8. Mann. H. C. Colton snd R. B. McClung. Six Jury men had been selected, but two had valid excuses. The first witness called was Patrolman Fred Mallett. -who- re signed yesterdsy. He and Officer Gruber had made the arrest, but before Mallett gave his testimony the Jury was ex cused until Thursdsy. ss Attorney Idle man desired to argue the Invalidity of the ordinance. Ordlnano Attacked. The argument of the lawyer was tech-nWi.- He ctstmed that the ordinance had not been properly passed by the city council, inasmuch ss the record did not show the proceedings. The chsrter provides that the proceedings must be s part of the records, snd the lawyer con tended that the records did not show the proceedings of the council tn regard to this ordinance. He also made another technical objection In claiming that the ordinance was not properly attested by O. T. Gsmble. who was then city audi tor. The records show that hd signed himself simply "Auditor." and did not add "for the City of Portland." By 1 o'clock Mr. Idleman had not com pleted his argument, and the court ad Journod until tomorrow, when he will finish, and Mr. Fltsgerald will be ready with his counter argument. The Jury will again .listen to the evidence Thursday- ' City 'Auditor Devlin was on hand with the records, he having been subpoenaed for that purpose. During th progress of the case the lawyers for the defense did not show what line of evidence they will produce to help clear theMr clients. For the past twc. months they have been prophesying that the demand would soon cease, but contrary to their expectations lt has been increasing from week to week. Mont., Oct. 13.-Will!am Stadts and Henry Jarves, who were arrested In Helena shortly after the dynamite explo sion on the Northern -Pacific at Bozeman, will be returned to that city for trial. They have been held here tinder vagrancy sentence, while the officials worked on the case, which Is now declared to be a very strong one. Among their effects was found a quantity of dynamite and severs fuses, and it Is said that a piece of cloth similar to that picked up at the scene of the explosion was also in their posses sion. they received. The cases of ManleJ Miller, former second assistant attorney-general of the postofflce depart ment, and Joseph Johns of Rockvllle, Ind., indicted on the charge of con spiracy to secure a bribe from Ryan, the turf promoter, were called by the I'nlted States court today. Pursuant to President Roosevelt's policy the district attorney s office Is augmented by the ar rival of government Attorneys Cochran and Rabb from Washington. On each side are about eight witnesses. Bottler against the councllmen is Invalid, and the city fathers will apparently have to pay out of their own pockets for the services of their attorneys. The plaintiff in the suit was injured in the collapse of the Second. . gjrect bridge ..over Maxnuam- gulch. and brought suit against the city, the mayor, the councllmen and other city officials for $10,000 damages. Tho suit was dismissed as to all defendants except the councllmen, on the ground that the charge of negligence waa sus tained only as to them.
