This new princi ple Is the main contention of the state. It Is that the ' right of appropriation of water . to reclaim arid lands is superior to the riparian right. The answer ' follows the overruling of the demurrer filed by Colorado to the complaint filed by the -State of Kansas. The answer reviews the whole history of irrigation, but makes its chief point en the assertion that the right te-irrigate) takes precedence over the ancient ripar ian right.
