The report in full U a follows: Astoria, Or, Oct. 31, 1907. - To the Honorable Board of Fkh Commis sioners, Salem, Oregon. Gentlemen: In regard to the hereto attached claim of Mr. E. IX Hume for $2515.10, which he claim to be due him under section 4081 of Ballinger and Cot ton'i code and statu Us, I respectfully report that the statute referred to was apparently intended for the purpose of encouraging puckers, ad others inter- ested in the artificial propagation of salmon, to maintain their own salmon hatcheries and carry on a system of hatchery work on streams that they were directly interested in, and if such work was carried on systematically and to the satisfaction of the Board of Fish Commissioners, that then the said board of fish commissioners would be privileged to pay over to such person .or persons, or corporation a certain por .tion of the moneys received from li censes issued for fishing and packing privileges on such river or it tributar ! es, not to exceed 60 per cent thereof; ."but in the wording of this statute, it ; seems to me that the main object for which it was intended, that is, the operation of salmon hatcheries, has been . omitted, as you will please see by re ; f erring to said section, which reads as follows: "When there shall be in operation on any river of this state, for the pur pose of stocking said river or it tribu taries with salmon, owned by any per son or persons or corporation, the board . of fish commissioners, upon proper evi dence that said salmon hatchery shall have been operated in any (year in such a manner as to produce a benefit to such stream equal to that derived from the same amount of money expended at hatcheries maintained aud operated by the board of fish commissioners, the said board of fish commissioner shall pay over to such penton or persons or corporations not to exceed 00 per ceut of the moneys received by such board for licenses from person engaged In fishing or packing fish on such river or its tributaries; the same to be used by such person or persou, firms, or corpo ration in propagating salmon in such river or its tributaries." Wthether the matter of leaving out the words "A Salmon Hatchery after the word "State" in the first line of the statute is serious 01' not aud make the statute of no effect, is a question that should be passed upon by the attorney- general. Assuming though that the statute is effective as it was apparently intended. I will state that this office has no reliable information of any hatchery operations having been carried on, on that stream by Mr. K. D. Hume or any on in his employ, excepting during the season of 1907, just passed. By referring to thi statement, you will notice that ho claims that he spent for operating expenses: - During the year 1901... $1043.69 . " ' " 1002... 13S9.47 " " 11)03... 759.07 " " 1904.... .00 "."' 1905... .00 V " 1906.... .00 V " " 1907... 2310.67 I would infer from this statement that he carried on hatchery operations during the years 1901. 1902. 1903 and 1907 at bis lower Rogue River hatcheries, and that during the years 1904, 1905 and 1900 no hatchery work was carried on by him, whereas, his claim calls for 60 per5 cent of all moneys received by this department for those respective years as well as of the years 1901, 1902, 1903 and 1907. Whether any such operations were carried on by him as his state ment shown, I have no direct knowledge excepting for this past season, and will mention relative thereto that during the forepart of July in 1901 I visited his lower Rogue River batching estab lishment which was at that time on the north side of the river, but there was no work being carried on there at that time; if any such work had been done there that season, it was done prior to my visit and the young fry were all liberated before I got there. In regard to hl Klk Creek hatchery establishment which Is situated on the upper Rogue River, I will tat that) during the spring of 1902 I visited thi hatchery ami found , it being operated by the United State bureau of fisheries and that all the expense connected with the operation thereof was being paid for, as I was given to understand, by said United States bureau of fisheries, Then again in the spring of 1903. 1 visited this same Klk Creek establishment ami found the same conditions still existing; that is, it wa being operated by the United State bureau of flsherir and alt the expense, connected therewith was being paid by the said United State bureau of fisheries. Sine 1903, I have not visited thi upper Rogue River hatchery, but from report received from the United State bureau of fisheries, I have been given to understand that the operation of this Klk Creek hatching establishment has been carried on every year since by the United States bureau of fisheries and that all of the expense connected with the establishment has been paid by the said United State bureau of flsheriea. Inasmuch a there seems to be a defect in the wording of the statute un.Ier which this claim la based, as I have herein shown. I think the attorney-general attention hould first be called to the matter before any action is taken; and as the claim is an un usual one, it seem to me that the entire matter should be referred to him the (attorney-general) for an opinion on the subject and I respectfully recommend that such be done.
