Ice Crciini SheibctsvJ1111 the unti(" f mcer" Phone 1181 J. II, DowUby, charged, with the mur der of Clcve Jennings, appeared before Judge Mi'lirlde yesterday, and the dale of hi trial wat tet for Monday, Sep tember 30th, John Smith and Howard Browne!! were appointed by the court, to defend him. The appearance of BowUby brought out a story that make hlin ft modern Damon. Th story of Damon and Pythla, on which i founded the order of the Kulght of Pythiat, It to well known, as tha exemplification, of true friendship and loyally, that to call man ft Pythiat la one of tha highest compliment he can bo paid him ft a man. The portion U where Damon, un der sentence of death, asks permiiilon to vltlt hit wife and family, at a dist ance, to bid them farewell. Pythias, hi friend, offer himielf a ft hostage for hla return In time lor execution at tun down. Should Damon not return at the Unit tet (or the execution Pythla wa to have tuffcrcd death through the laxity of hi friend. After Damon bid farewell to hi loved ones be older bin hone only to find that bis lave, through love of hi mater, hat (lain the horte, that he would not U able to reach the distant city in time, and hit life thus be spared Damon ttealt ft horse from a neighbor, arid, riding like a whirlwind, reuchet hi destination just In time to prevent the execution of hit friends Bowl-by, under ft charge of murder, nun conllned in the county jail and hi friend, by qualifying in tmall amount, raised bonds of $2500 for his appearance at this term of court. Bowlsby went to hi former home t North Bend, on bit release, and awaited the opening of court. As the date of the opening of court drew near" BowUby grew nervous. Water transportation is at beat oncer tain, the Alliance had met with an aoci dent at the mouth of the Willamette and it was uncertain when the would leave North Bend. To make assurance Jjubly sure that he would appear at the open ing of the court, Bowlsby made ft refer vation on the steamer Breakwater that wat to have on September 5. When the day of sailing came he wag ready to leave but wa Informed that all aceom moJationt were sold and throuph an error hi reservation had been overlook ed. Ho wat told that another steamer, the Alliance, would leave in time for hlih to reach Astoria before the 10th, but, thinking of hie friend, who had given bonds for him, and could ill afford to have the bonds forfeited, he was de termined to takt passage on that steam er. How he did it has just come to light. Bowlby says little about it but admits, on questioning, that the account is truthful, lie packed such articles as I he woiihl neeil on tha trin. in his crln. I was altraciea to t"e passengers ooa ruing the steamer, In the regular way, by the I gangplank, he slipped over the stern of the boat nnd etowed himself away I When at st the purser approached him demand ing his ticket. He had none but ! offered his fare. There wew no ileep 1 . . ing accommodations, not taken up, so Bowlsby, although paying flrst-class fare, was compelled to sleep on the deck, in the steerage, even the chairs in the smoking room being occupied. He reach ed here on Friday, September 0th, and was In the court ou opening day but the matter was not taken up until yes terday. He Is here, his bondsmen need not worry and now he is awaiting the late of his trial. There is similitude In this ease to Damon and Pythias, Id Bowlsby hurry ing to Astoria, to be tried for his life, yet saving the money of his friends who had made his temporary release pos sible.
