the courts nars been asked by the
plaintiff company for a restraining order
enjoining defendant from uing the
words "Toke Point," on any of its boxes
and to discontinue the one of the name
altogether in connection with the sale
of any of ita oysters. It ia alleged that
the defendants are now enjrsged in sell
ing oysters as Toke Points when said 1
oysters are not, and do not come from
the oyster beds owned by plaintiff. It
ia alleged that by reawn of uvh sets
plaintiff has kt trade and is dsmagd
in the sum of $150. The company
claims the right to the trade-mark,
having originated it and regitered it
in the patent office at Wahingti,
D. C."

came down from Portland yesterday

She is loaded deep with foodstuffs for
Japsn and will get away on the first
available tide.
The pilot schooner Joseph Pulitser is
till in the city channel and will leave
out for her station tomorrow. If there
waa Portland Marine reporter here
he would probably report her- "bar
bound."
The French bark Jean Baptiste will
enter at the cutom house here today
and dock at the Elmore pier tomorrow
morning and commence dischsrging
about 100 tons of Australian coal for
S. Elmore A Co.
The steamer Homer is still backing
and filling around these water, ghe
haa been bar bound for a week, broke
her steering gear and manipulate her
self with hauling tackle and her twin
