Tli Common Council met in regular session for the second time iu Novem ber last evening. The full board of nine was in evidence, with Mayor Suprenant in the chair. Judge Anderson in charge of the records, and the following city officers in attendance: City Attorney A. M. Smith, and Superintendent of Street J. F. Kearney. After the read ing of the minutes the following matters were presented and disposed of, in e que nee: A communication was read from City Attorney A. M. Smith which wa, in effect, an opinion from him on the ques tion heretofore referred to hira by the Council, as to whether land, which does not abutt upon a street which it is proposed to improve, can be legally in cluded in the assessment district made for such an improvement? Mr. Smith states that the charter, in addition to prescribing the territory specifically abutting upon a street under prove of improvement gives the Council the right to assess "such other lands, a in the opinion of the Council, may be benefit ted by the improvement." In his opin ion any lands that are amenable to the proposed improvement, may be included in the aasessuient, provided the Council thall deem them susceptible of the bene fits accruing. The report was filed. Communications from the following people were read and duly referred: From C. Norman and eight other pray ing for the improvement of Birch street, from Fifty-first to Fifty-third street: From P. R. Davis, in relation to the building of a sidewalk along his prop erty on Irving avenue. From C. Paulson and other praying for permission to construct a shed, 12 by 12 feet in dimensions, at the slip at the foot of Fourteenth street. From P. A. Peterson and A. G. Snow, asking for renewals of sale license. A remonstrance from A.
