Court convened at :S0 and throughout the day 'he time was occupied with hearing evidence. It has been part of the Plaintiffs con'entlon that the rail trad company did not properly guard against aecllenis because precautions agiinst slide wr not taken, and that slide were most likely to occur during wet weather. For the purpose of show ing the precipitation on the day of the dlsas'er. Weithn- Observer Johnson was pUced on the stand. He stated that the rainfall on January 12 was !-72 In ches. while the average precipitation for the days on which the greatest amount of rain fell during the past ten years was S.SO Inches. Other witnesses examined yesterday were Charles Mc Donald, a passenger on the night of the arcH-nit: Peter Nellson and Mrs, Scott. The latter testified that deceas- ej was 4 years of age. In good health at tbe time of his death, and a man of exemplary habits- An Interesting feature of the case was brought up by the attorneys for Mrs. Scott, who show ed bv statistics that, according to the rules adopted by Insurance companies deceased would have lived ?S years longer bad It not been for the disaster on the road. Wiien the plaintiffs case was closed, the attorneys for the com pany moved dismissal of the suit, on the grounJ that eveldxnee showing the liability of the company had not been presented. Judge McHrlde took the matter under advisement .and will make a ruling this morning. She was flftv-four days on the trip. The vessel remained In the lower har bar last night, as Dr. Earle, of the quarantine service, will not examine her until this morning. The Nelson has never before made this port She Is a small vessel, of 1217 tons, and an old- timer, having been In service for near ly a quarter of a century. The Nelson comes In ballast, but, a far as can be learned. Is not chartered. ALONG THE WATERFRONT. The bark Harry Morse is at the A. A C. whirf. discharging the remainder of her Alaskan salmon cargo. The schooner Sweasey and the Brit ish ship May-field were taken UP the river yesterday. The schooner will complete her lumber cargo, while the ship will load grain. The British steamship Glenmorgan- shlre. which Is on the way down the river, was "expected" last evening, but failed put In an appearance. It Is said the vessel Is drawing twenty-three feet, but this statement la probably ex aggerated. The Glenmorganshlre's car go was not finished at Portland, and she will take on 1000 tons at Astoria The trsnspJrt Palatine arrived down the river yesterday, after a trip of three Jays. She wa drawing- twenty-one feet six Inches when she arrived. On the trip down the vessel worked the tides and .nanaged to come through without grounding.
