Upon the front aeat were both men and women who came from the 1 Lewis and Clark district. All were Interested In the proceedings and there were several who came to add . whatever evidence they could in con - mMlon . with the tragedy. - Only one, . hniiat'ir Innk ,ihp. witness stand, as the doctor composing the commiaalon I felt satisfied at an early stage in the proceeding that Hilstrom was a llgi tlmute subject for entry at the state aslura for the Insane. ' There were many witnesses but the most important were Hilstrom and his wife. Tn question of Hllstrom's mental condition, however hung upon a slen der thread, as far as the mala test! . mony was concerned. As a matter of fact, Hilstrom is one of -the, moat fortunate murderers that . ever escaped the gallows. In a word he Is much more a fool than a lunatic That a murderer can escape the gal- . lows because he is a fool is due sole ly to the American Jury system, by which a man Is presumed to be . Judged by his peers. In every matter save that Involving , the killing of Lake Mooers, Hilstrom t. appears perfectly sane. This was proved by his story from the witness .stand yesterday; It has been estab , llshed by his actions in the past - When Hilstrom took the witness stand yesterday the worst opinion thai , was framed was that he wa a man of simple mind. All his testimony wa perfectly straightforward except- . Ing that which had direct bearing up on the shooting of Mooers. Probably the most consplclous characteristic as manifested by Hilstrom was his ap parent Indifference as to the enormity of hit deed. He seemed not to realist in the slightest degree that by his foul . deed bs had terminated the lift of a! man, who. In life, had been ont of his - st- trlswas. Xtd, , had . HUstfom been testifying as to the prospective returr.es of his next hay crop he could not have been more nonchalant Hilstrom Is a confessed lover of whisky and t was at first believed thui it was while lu an intoxicated state tl-at he killed Lake Mooers. This conclusion, however, is no longer en tertaind by those best acquainted with the facts. When Hllstrom's younpest child was due about six weeks ago he took occasion to cele brate tht event by ordering a gallon of whisky, although the new visitor had not yet arrived. This liquor, which was the last he is supposed to have had. was procured upon the fol lowing order sent to Alex Grant: Oregon, Alelvllle, the IS. Aside from Hilstrom, probably the most Important witness was his wife, Both the eldest son and daughter were sworn but the wife gave the most im portant evidence concerning Hllstrom's mental condition. For several days. she said, she bad believed her hus band to be unbalanced. "He would tell me that he knew thai certain men among whom was Mooers, Abercrombie and others, were intent upon killing him,' she said, "but I thought he was mistaken and told him so. But when. I disagreed with him he always became mad, and I finally grew to believe that possibly he was right" ' Bid you have any Idea that your husband intended to shoot Mooers w hen he came to the house on the day he was killed?" asked Judge Gray. "No, sir," was the response. "My husband was shaving himself at tht time, preparing to come to town. As soon as he heard the knock at the door he said, 'Walt till I get my gun.' Wlv.-n I opened the door I saw Mr. Mooers and the other gentlemen." "Didn't you step aside after you op'.-ned the door and Immediately prior to the shooting?" asked the court "Yes, sir," was the reply. "Why did you do that?" was asked. "Well," Mrs. Hilstrom replied," I saw that my husband bad a gun and that he was pointing it toward me. Of course I stepped to one side right away." After the close of the examination Mrs. Hilstrom gathered her family and started for their temporary lodg ing. Meeting them In the hallway Judge Gray asked the unfortunate woman If she had any supplies on hand at the house. To this she replied that she had but little In the way of food. "1 11 fix that for you," said Judge Gmy, and then, turning to the eldest sop, he said, In a most kindly tone: "My boy, you are now at tht head of the family and must do what you can to care for the little ones. Both your mother and I will expect you to be a perfect little man and . do your besi to make your home as happy at powlble under the circumstances." Dr. Beck man, however, announced his determi nation to aid Ms Individual opinion to the commissioners' conclusions, ex pressing the conviction that Hilstrom shmil 1 be committed to the asylum for life. Said he: "The man Is dangerous and I do not believe he 3houlJ be allowed to leave tht asylum upon the Oral manifesta tion of mental balance. There is every reason to believe that HiUtrom ha.s lost hU mental equilibrium, and than his condition is of a hereditary nature. It would be both unwise and unsafe to allow him his liberty upon the nrst apparent return of reason. A inn like he might be apparently sune for years and suddenly go wrong. The Call says: When the will of Captain L Frit-oman, who died in the Palace ho tel Sunday morning is opened, It will be found that he had left an estate valued at $750,000, three-quarters of which han been left to charity. After bequests, which will reach an aggre gate of '00,000 are paid, the residue is bequested to the Hebrew home for a?ed and disabled persons. This lega cy will amount to at least 1250,000.
