It was Mr. Fogarty's duty to see
that the contract was enforced to
the letter. If not why have a con
tract? It matters not in cases of
this kind whether the contractor
makes ten dollars a day or loses it
as far as the county is concerned.
Contracts must be enforced else
they are worse than useless and
prevcht others who would fill their
contracts from bidding.
The Commissioner hud no right
to accept the statement of a by
stander and one to whom the claim
for work bad been assigned. The
additional work spoken of was not
done until after September 9th
when the work had been accepted.
Mr. Ranta's affidavit clearly
hi tows this, for if the work had been,
done why did the contractor do any
more. The added work did not
materially change conditions.
The recall amendment passed by
the people June 1st is an amend
ment to the Constitution ' of the
rotate of Oregon. It provides for
the duties of the County Clerk in
ease a recall petition is filed. It
takes 262 voters to enforce the re
call between this time and the next
general election. I am only one of
the 202.

those wishing to do so.
