The Xudcnr of Pearl Bryan Gives tbe Death Penalt). Newport. Ky.,May 19. Scott Jack ton's case went to the jury at 10 o'clock this morning. At 12:05 P. M. the jury returned amid a death-like still ness. The foreman banded the verdict to the clerk, who read as follows: "We, the jury, find the defendant, Scott Jackson, guilty of murder ia the first degree, and fix the penalty at death." The judge had previously announced that do demonstration by the specta tors would be permitted. Consequent ly the verdict was beard with silence, but immediately upon the adjournment of the court the tpectacrs rushed to the jurors and shook bands with them heartily. Jackson showed no feeling except in the ashen paleness of bia face. Tbe father and brother of Pearl Bryan were present. Tbe representative cf the United States quoted tie treaties exist ing between tie United States and Spain, and doubted the right of tie latter to try American citizens and other! sailing under the American flag, by other tian civil law, adding that ia tie letter they must be judged by ordinary and not by military and naval courts, and be permitted to employ legal counsel and present witness in A note by the judge advecate-sen-eril, which bad also been endorsed by Admiral Navarro, the highest naval officer of Spain ia Cuba, ruling Consul General Williams' protest as without good ground and out of order, was Also read and noted. Within four hours after the court martial closed its session, at a special meeting in the Afternoon, its members sent to Admiral Navarro a sealed ver dict, which was immediately approved by the naval chief. The sentences of all five prisoners to death, in accord ance with tbe verdict, was signed at once, and preparations made to have the mea shot. Receiving no satisfactory response from the amdiral, nor even an invita tion to attend tbe proceedings, neither Consul-General Williams nor any at tache of his cfSce was present at tbe court-martial, nor was he allowed to tee the prisoners until after the trial had closed. Naturally be laid tbe whole case before the state department at Washington early, and received in structions as prompt as energetic. hen these arrived, be went imme diately to tbe palace, where a stormy interview with Captain-General Wey ler occurred. The general told the consul-general that ff the men had been convicted, as the latter supposed, tiey would most certainly be shot at sunrise the following morning, despite any protest the United States might make. II you shoot them," said Mr. Wil liams, "my government instructs me to close its consulate here and demand my . passports, and I shall most certainly nolo you and your government respon- sible should these prisoners be executed before our protest be given due con sideration." When Mr. Williams bowed himself out of the general's presence, he drove back to his office.
