hi imiii i w ir tTmmkmmmimmmmm tw335lSBBl THE DAILY COOS BAY TIMES. MARSH FIELD, OREGON, TUESDAY, SEPTEMBER 15, 1908. Fi fe'i Kf! H hi II w ,,' LICENSE CASE Oregon Law Does Not Apply to Those Not Regularly Follow ing the Business. No license is required to sell fish in the state of Oregon unless the party selling them follows it as a regular occupation. This la tho construction that De puty District Attorney L. A. Liljeq vlst and Justice C. A. Pennock of Marshfield, have put upon the Ore gon fish license law. In consequence, Abraham Gustavson has been freed on the charge of violating the meas ure and also was discharged on the information accusing him of steal ing the fish that ho sold. The latter decision was based on the lack of evidence. The two charges against Gustav son were sworn out in Justice Pen nock's court by O. A. Wlrth, a fish erman who pays a license to soli fish. Although Gustavson sold but one fish, Wlrth and other fishermen reg ularly engaged in the business thought he was infringing upon the rights guaranteed them by the li cense. The Oregon statute covering the fish license says that all persons en gaged in tho business of selling fish must procure a license. Mr. Liljeq vlst and Justice Pennock Interprets this to mean just what it says and consequently that It does not apply to persons who may sell one fish In a year. Gustavson was alleged to have stolen the fish from the rear of a local saloon and while he did not ex plain In detail how he came by the fish, the accusers were unable to prove to the satisfaction of tho court that Gustavson really did steal tho fish.
