The E. B. Burns es tate has won Its suit to quiet title to a tract of land near Rogue river, which Burns used for a fish salting ' v plan'tv This laud Burns had pur 1 r chased from Mrs. Frances Kennedy, f but there being an error in. the deed, -I -" oho- asked to have the description corroded. This was agreed to. i- Hume, in the meantime, had offered her a higher price for the land. In order to correct the mistake in the .description she arranged that Burns should convey the land back to her and she and husband would convey to Burns by a corrected deed. The papers were accordingly drawn up and the Burns deed was signed. Mrs. Kennedy then asked permission to r 'take It to the door to show it to her husband before they signed their r- deed,' but-instead of coming back -she took the deed to the court house, had It recorded and immediately con- .veyed the land to Hume. Burns then brought this suit to quiet titlo, charging the Kennedys and Hume with conspiracy and fraud. The decree In the lower court, after trial before Judge Hamilton, was in favor of' Burns and on appeal this is affirmed. The Supreme Court, in an opinion by Justice Eakln, holds that It is Immaterial whether Hume was a party to the fraud or not, for there was no delivery of the deed. The grantor had merely let Mrs. Kennedy take It to the door to show to her husband, with the agreement that it should be returned, and there was no intention that It should be deliv ered as a conveyance until she deliv ered a corrected deed In the place of the conveyance that contained an error.- Since "Mrs. Kennedy acquired -..no title by the deed, she could con vey none to Hume, even though he wore an Innocent purchaser for value without notice." By this decision the Burns estate has undisputed title to the land which enables them to handle flsh from Rogue river. Weicor, July 18. There Is every Indication that the P. & I. N. rail road Is planning to build a branch lino into a part of, if not clear through Long valley. A surveyor and his crew have been over the con templated route and this weok the surveyor reported the route very feasible, easy of construction and the country a rich one. Just what the plans are cannot be learned. General Manager E. M. Helgho of the "Pin" road is in Boise, appear ing yesterday as a witness in the Haywood trial. When approached last night, and asked regarding the above dispatch, he said: "I don't like to talk about that matter. I don't like to appear as 'peddling hot air,' and that Is what it would look like it I told you the plans, which may be some time In being realized. I will say that we have contemplated n plan for running a branch line from Meadows, when we have reach ed that point, to Lardo on the Pa yette lakes and from Lardo south through Long valley to Roseberry, perhaps even further. A surveyor has gone over the rute and has re ported a 2 per cent grade can bo secured. It would not be a difficult piece of road to build. It would not be expensive in construction and I believe it would be a paying ven ture. Long valley is conceded to be the best wheat se coititnn shrdlu the best wheat section in the state. Fine fruit Is grown there. The land is all taken up and the-farmers are all prosperous even under the exist ing conditions. With an avenue to a quick market Long valley would soon become a great agricultural district." Mr. Heigho was serious in his above statement, but he soon became humorous. He said: "A good many statements have been credited to me about the plans of the 'Pin' road, I wish you would now state that in an interview I said this: 'As soon as the P. & L N. railroad shall have reached Meadows I propose to make that city the; hub of the continent. Branch lines, will be quickly constructed to Cape Cod, Key West, Hudson Bay, Cape Hat teras, Nome, and to some appropri ate European point, probably the city of Altama in the Alps. The track across the Atlantic will be supported by balloons filled with hot air from a power plant at Caldwell with which I have already opened negotiations. COOS BAY YIELDS 100-POUND FISH Julius Egenoff made a great catch Thursday night while fishing near the creamory across the bay. Ills net contained six fine sturgeon, the largest of which weighed 154 pounds and measured over seven feet in length. The flsh were brought to Marshfleld and the catch was soon fold out to ready customers. M. J. McKenna, secretary of the Cody Lumber Company, was over from the Coqullle river yesterday. The company's steam schooner Ban don, lately launched at Porter, will bo taken to San Francisco under bal last for Installation of her machinery, Capt. C. P. Jensen in charge. The schooner will ply between San Fran cisco and Bandon.
