FREIGHT RATES.
Statistics compiled show that the
j railroad rate law, winle it has elim-
,inated discriminatory rates and thus
removed the foundation upon which
some of the most gigantic trusts in
t-.tho country were built Is not without
iits flaws. Tho railroads are now
charging the people $500,000,000
more annually for freight haulage
than before the lav went Into effect.
Thus, while the shipper in the small
town can now ship to neighboring
: -cities for the same proportionate rate
, that the big shipper In the large
city pays, the freight charge has in
creased to an extent that eats Into
profits at an alarming rate. It is
apparent that the railroads are let
ting tho people pay for the new rate
lilll. As a remedy for this It is
: thought that the next Congress will
And it necessary to pass a law coin
polling railroads to base freight rates
on the physical valuation of the properties.

ticles of Incorporation of the Coos
Bay Wagon Road Company, the grant
made by tho United States Govern
ment to tho State of Oregon for the
purposo of constructing tho "Coos
Bay-Roseburg Military wagon road,"
l)ut also the supplementary articles
of incorporation. Tho papers appear
in tho order of dates In which they
were filed. First appears tho orig
inal articles of incorporation dated
April 9, 18G8. Following these
comes the act of Congress on De
cember 8, 1SC8, granting to the State
of Oregon the lands for the purpose
of constructing the road. The last
paper is the supplemental articles of
incorporation of the Coos Day Wagon
Road Company, dated April 8, 1872.
Tho papers from which tho follow
ing copies are made are furnished
through tho kindness of W. C. Har
ris, tho Sumner postmaster, and havo
a lengthy history. They wero loft
with a neighbor of Mr. Harris, years
ago, by a stranger, who said he would
bo back in tho course of a few days
and claim them. Tho man never re
turned and his Identity remains a
mystery.

AN ACT DONATING CERTAIN
LANDS TO THE CCOS BAY WAG
ON ROAD COMPANY.
Whereas, The Congress of the
United States, at the session begin
ning on the 7th day of December,
ISC 8, passed an act donating lands
to the State of Oregon, which act is
hereby set forth, towit:
An act granting lands to the State
of Oregon to aid In the construction
of a military wagon road from the
navigable waters of Coos Bay to
Ro3eburg, in said state.
Be It enacted by the House of Rep
resentatives of tho United States of
America, in congress assembled:
That there bo, and hereby Is,
grnnted to the State of Oregon, to aid
In the construction of a military
wagon road from the navigable wat
ers of Coos Bay to Roseburg, alter
nate sections of public lands, desig
nated by odd numbers, to the extent
of three sections In width on each
side of said road; Provided, that the
lands hereby granted shall be ex
clusively applied to the construction
of said road, and to no other pur
poses, and shall bo disposed of only
as the work progresses:
Provided further, That the grant
of lands hereby made shall be upon
the condition that the lands shall be
sold to any one person in quantities
not greater than one quarter section,
and for a prico not exceeding two
dollars and fifty cents per acre; and
Provided further, That any and all
lands heretofore reserved to tho
United States or otherwise appropri
ated by act of congress or other com
petent authority, be and tho same are
hereby resorved from tho operation
of this act, except so far as it may bo
necessary to locate the routo of said
road through tho same, in which
case the rlght-ofway to tho width of
one hundrer feet is granted;
And provided further, That tho
grunt hereby made shall not embrace
any mineral lands of tho United
States, or any lands to which home
stead or pre-omptlon rights havo at
tached. Sec. 2. And bo It furthor enacted,
That tho lands hereby granted to said
State shall bo disposed of by the
Legislature thereof for tho purpose
aforesaid, and for no other; and tho
said road shall bo and remain a pub
lic highway for tho uso of tho gov
ernment of tho United States, freo
from tolls or other charges upon the
transportation of any property,
troops or malls of tho United States.
Sec. 3. And bo it furthor onacted,
That said road shall bo constructed
with gradation and bridge as to per
mit its regular uso as a wagon road,
and in such other special manner as
tho Stato of Oregon may prescribe.
Sec. 4. And be It further enacted,
That tho Stato of Oregon is author
ized to locato and uso la the con
struction of said road an additional
amount of public lands, not previous
ly resorved to tho United States, nor
other wlso disposed of, and not ex
ceeding six miles in distnnco from It,
equal to tho amount reserved from
tho operation of tho act In tho first
section of tho same", to bo selected In

Siv- 5 And bo it furthor onacted,
That lands horoby granted to said
Stato shall bo disposed of only In tho
following manner; that Is to say,
lor that ten continuous miles of said
road are completed, then a quarter of
the land hereby granted, not to ex
ceed thirty sections, may be sold, and
so on from time to time until said
road shall be completed; and If said
road is not completed within five
years, no furthor sales shall bo made,
and the lands remaining unsold
shall revert to the United States;
Provided, however, that tho entire
amount of public land granted by
this act shall not exceed three sec
tions per mile for each mile actually
constructed.
Sec. C. And be It further enacted,
That the United States Surveyor Gen
eral for tho District of Oregon, shall
cause said lands so granted to bo
surveyed at the earliest practicable
period after t'he state shall have en
acted the necessary legislation to car
ry this act into effect.

BE IT ENACTED BY THE LEGIS
LATIVE ASSEMBLY OF THE
STATE OF OREGON:
Sec. l.-jsTJiat there Is hereby
granted1 to the Coos Bay Wagon
Road Company all lands, rights-of-way,
rights, privileges and immuni
ties heretofore granted or pledged to
this stato by the act of congress, In
this act heretofore cited, for the pur
pose of aiding said company In con
structing the road mentioned and de
scribed in said act of congress, upon
the conditions and limitations there
in prescribed.
Sec. 2. There is also hereby
granted and pledged to said com
pany all monies, lands, rights, priv
ileges and immunities which may
hereafter be granted to this state to
aid in the construction of such road
for the purposes, and upon the con
ditions and limitations mentioned in
said act of congress, or which may be
mentioned in any further grants of
money or lands to aid In construct
ing such road.
Sec. 3. Inasmuch as there is no
law upon this subject at the present
time, this act shall be In force from
and after Its passage.

pany be and aro hereby authorized

plementary article of incorporation
of said company. Towit:

by assents to and accepts tho grant of
land and right of way and all of the
conditions and provisions of the act
of congress approved March 3rd,
18G9, entitled, "An act granting

the construction of a military wagon

Supplementary Articles of Incorpora
tion of tin Coos Buy Wagon
Road Company.
Article 1. The eastern terminus
of said road is hereby fixed at Rose
burg, Douglas County, Oregon, and
tho western terminus of said road Is
fixed at a point on the navigable
waters of Coos Bay, Coos County,
Oregon, and tho routo of said road
shall be along the line thereof as
heretofore surveyed out, subject to
such changes and modifications as
jnny be made for the. benefit of said
company.
Article 2. The enterprise, busi
ness pursuits and occupation in
which this corporation proposes to
engage In addition to that expressed
in the original and supplemental
articles of Incorporation, heretofore
made and filed, is to purchase, take,
accept, and receive, own and hold
any and all grants of land, of per
sonal property, or thing of value
from the United States or from the
State or Oregon, or from any person
or persons or corporation or company
and to purchase, own and hold real
and personal propeify of tho kind
and to tho extent said corporation
may deem necessary or advantageous
and to bargain, sell, transfer, and
convey any and all real and personal
property which said corporation may
now or at any time own, and to do
and perform any and all acts neces
sary and requisite to tho taking, se
curing, holding, selling and convey
ing any real and personal property of
whatsoever description and to con
struct, own and keep a Toll Road,
Toll Bridges and Ferries, and to re
ceive and collect toll on any road or
part of road, bridge and ferry by this
company owned and kept, and to
make, alter or change the line or
route ot tho said road, bridges or
ferries and toll grades. Also to
organize, establish and maintain a
system of emigration from tho other
states and territories of tho United
States and from Europe, to the State
of Oregon, and to do and perform
any act in conformity with law, that
said company may find necessary and
deem proper In aid and furtherance
of any of tho objects and purposes
aforesaid.
